Appendix No. 1. Prohibited and conditionally admitted goods

Article 1. Prohibited goods

The subject of the Offer may not be goods and services that have nothing to do with electric or ecological vehicles, and the following Goods:

  1. containing blatant pornographic content;
  2. promoting a fascist or other totalitarian system of the state or inciting hatred on the basis of national, ethnic, racial, religious differences or due to lack of denominations - with the exception of goods of artistic, educational, collector's or scientific value;
  3. violating personal rights of third parties;
  4. music, films, software and other Goods that infringe upon intellectual property;
  5. non-original products (so-called counterfeits);
  6. explosives and hazardous chemicals;
  7. drugs, psychotropic substances, intoxicants;
  8. medical products;
  9. alcoholic drinks;
  10. tobacco products, electronic cigarettes, refill containers and parts therefor;
  11. human or animal organs;
  12. Live or dead animals (as well as parts or derivatives thereof) belonging to the species included in the currently applicable Annexes A-D to Council Regulation (EC) No. 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein;
  13. dogs and cats placed on the market outside their rearing or breeding places and animals without a pedigree or birth certificate;
  14. company shares, stocks, bonds and other securities, receivables, units of investment funds, insurance policies and products, and any other financial instruments offered as a form of investing or investing cash, with the exception of tangible securities with a collector value only;
  15. cryptocurrencies (e.g. bitcoin, litecoin, dogecoin, etc.) and related services and products;
  16. software violating the manufacturer's license, in the trial version, freeware, shareware, abandonware;
  17. software adapted to conduct activities that violate the law or good manners;
  18. website addresses and FTP servers (excluding internet domains);
  19. information and instructions that are not of a service nature, in particular: advice on bypassing regulations, using online systems that offer financial benefits (e.g. payment for displaying banners or receiving e-mails, information such as "how to perform ...", "how to find ...", "how to earn...");
  20. access to torrenting sites, accounts on free websites and related services (e.g. likes, opinions, comments);
  21. access to erotic / pornographic sites and virtual currencies applicable to such sites;
  22. accounts in affiliate and loyalty programs and services related to such programs;
  23. databases (including personal data or email address lists);
  24. mail order and direct sales catalogs for ordering goods, except out-of-date catalogs of only collector value;
  25. master's, diploma, bachelor's and matriculation theses, essays and other works of this type and services related to the creation of such works;
  26. stock exchange investment systems and systems for number games and bookmakers, as well as services relating to the provision of assistance in joining and placing such games, with the exception of official book publications bearing an ISBN number;
  27. fishing gear and fishing gear, the possession of which is restricted by law;
  28. weapons and ammunition within the meaning of the Act on Weapons and Ammunition and essential parts enabling the production of such weapons;
  29. pyrotechnics;
  30. vehicle registration certificates and vehicle cards offered without the vehicles to which they were issued and vehicles without documents;
  31. discount and rebate coupons in the form of a promise entitling you to obtain a discount or other benefit for the future purchase of Goods outside GO ELECTRIC (does not apply to GO ELECTRIC gift cards offered by GO ELECTRIC );
  32. publications in electronic form (eg books, poems, guides, so-called e-books) listed outside the "E-books" category;
  33. gold in the form of bars and their copies, coins (subject to article 2 point 5 below) or goldsmith scrap and silver in the form of bars and their copies and scrap;
  34. prepaid payment cards (so-called prepaid cards).
  35. telephone, registered prepaid cards.
  36. counterfeit notes and coin in circulation (counterfeits / imitations of Polish and foreign currency).
  37. Second-hand goods that should not be reused for health protection or hygiene reasons.
  38. All kinds of codes, passwords, tokens, keys or accounts (hereinafter collectively referred to as "Codes") that allow access and use of services allowing for breach of security or access to equipment or services, with the exception of Codes, which are offered by entities operating the official authorized resale activity, operating under individual agreements concluded with Goelectric.pl.

Article 2. Conditionally admitted goods

The following types of Goods may be issued as part of the Transaction, provided that the items meet the conditions set out below and the description of the Goods on the Transaction website contains the indicated content (Goods allowed conditionally):

  1. Audiobooks and videobooks that are not official publishers. Condition : The seller must be the sole author or publisher of the publication. Required description elements : Specifying the given publication of the ISBN number in the National Library's online database on the website (eg http://e-isbn.pl) .
  2. Tickets for artistic, entertainment or sporting events. Condition : They can only be offered with the Buy It Now option, and the ticket price cannot be higher than its nominal price. Required description elements : Information in text form about the nominal price of the ticket.
  3. Warranty cards. Condition : They cannot be sold individually (they must be attached to the Goods covered by the guarantee).
  4. Ammunition (e.g. projectiles, mines, grenades) or essential parts thereof. Condition : The ammunition has no combat characteristics. Required description elements : Statement that the ammunition is decapitated.
  5. Gold coins minted before 1800. Condition : They can only be offered in the "Gold coins up to 1800" category by participants of the "Professional Numismatics" program.
  6. Commodities under the "Investment Products" category. Condition : They can be offered only by entities operating on the basis of separate agreements concluded with Goelectric.pl.
  7. Goods from the category "GSM Accessories" - "Antennas and amplifiers". Required description elements : Provision of information that: “It is forbidden by law to install and use GSM / UMTS / LTE repeaters, also called repeaters, by unauthorized persons. Only mobile network operators have the right to install such devices. Failure to comply with the above may be considered an act subject to a fine, and in the event of persistent action, a penalty of restriction or imprisonment for up to 2 years. "

Appendix 2: Rules for creating a Transaction description;

Article 1. CONTENT OF THE OFFER

  1. In order to create a description of the Transaction, the Seller fills in GO ELECTRIC website, in which, in particular, the title of the Transaction, the description of the Good, its category and the type and manner of the Transaction should be specified (including the duration of the Transaction and, as selected: the starting price, optionally the minimum price and select whether to enter the Buy Now option) and payment conditions. The description of the Transaction should be supplemented with at least one photo presenting the offered Goods. In the sales form, the Seller may also, by selecting additional options, determine a specific method of presentation and promotion of the Transaction in GO ELECTRIC .
  2. It is forbidden to include in the description of the Transaction content that violates the law, the GO ELECTRIC Regulations, as well as words, expressions or phrases that have been used contrary to moral standards and drastic content.
  3. It is permissible for the User to present in the Offer content that is stored on external servers (not belonging to Goelectric.pl), however, they cannot be essential content.
  4. Only information about the offered Good may be placed in the "Description" field of the Offer and in its title. It should also include information such as delivery details, warranty conditions, a description of the complaint procedure, such as repairs, and information on withdrawal from the contract. Other information should be placed in the appropriate tabs, and contact details and any other information about the seller in the "Seller's profile" tab.
  5. The photos posted in the Offer must only refer to the offered Goods. It is allowed to present the Goods in the context of its use or arrangement. Photos may show certificates, technologies, graphic elements (e.g. arrows). Inscriptions are forbidden, with exceptions: brand / manufacturer's logo, color and pattern markings, numbers and units.
  6. Banners on the list of offers cannot contain advertisements, promotional and announcement content regarding activities conducted outside GO ELECTRIC and contact details. Brand / manufacturer logo is allowed.
  7. The headers must relate to the offered Good. They may not contain text, the Seller's logo and contact details. It is also forbidden to provide promotional and announcement content regarding activities conducted outside GO ELECTRIC . Brand / manufacturer logo is allowed.
  8. Attachments to the Offer must relate to the offered item. They cannot duplicate the information placed in the "Description" field. The content of the attachment must correspond to the type of the selected attachment. The information contained in the attachments may not violate the other provisions of the GO ELECTRIC Regulations.
  9. The offer may not contain advertisements, promotional and announcement content (eg "buy / replace" proposals) and other elements facilitating the purchase of goods and services outside GO ELECTRIC .
  10. It is unacceptable to leave the Buyer with a choice as to one or more significant features of the Goods, such as, for example, size, model, etc. the number of available colors or graphic designs.
  11. In the case of multi-variant Offers, it is allowed to combine Offers with Goods that have the same purpose, are of the same brand and are displayed in the same category.
  12. It is forbidden to include keywords in the content of the Offer, including its title and parameters, in order to manipulate the results of searching for Goods in GO ELECTRIC .
  13. Elements of HTML, JavaScript, Java or other programming languages or any other technologies may not be used for any activities adversely affecting the functioning of GO ELECTRIC or misleading other Users.
  14. In the content of the Offer, the Seller may include website addresses (in any form, e.g. references, links) only if:
    a. no commercial activity is carried out through them, and the content to which they refer is used only to expand information about the Goods;
    b. it is the subject of the Offer, e.g. internet domain, hosting service, website.
  15. As part of the Offer, the Seller may grant a discount or offer a free add-on to the Good (free of charge), provided that the Buyer receiving the discount or free add-on is not selected by lot. Both the rebate and the free one must be clearly stated.
  16. The Seller is obliged to indicate in the content of the Offer information about the date of the contract (shipping time).
  17. The price of the Goods specified in the Offer by the Seller must be gross.
  18. It is forbidden to include in the content of the Offer information that in any way differentiates the situation of Buyers in the use of the payment service specified in Annex 7 to the Regulations.
  19. As described in points 4 and 16 above, the Seller is obliged to provide legible information in each offer regarding. guarantees, complaints, repairs, order fulfillment time and returns, i.e. whether the Seller requires the Buyer to fill in the Withdrawal Form. They should be placed at the end of the offer description in a few lines of text. As regards, in particular, the time for return, the Seller may not provide it and may not provide a value lower than that guaranteed by the GO ELECTRIC Buyer Protection Program ( Annex 9 ), regardless of whether they are new, refurbished or used goods. Also, if the Seller does not provide either warranty or repair, this must be clearly stated in the offer. In addition, if the Seller has common terms for all its products, he can briefly enter them in his Seller's profile in GO ELECTRIC .

Article 2. PHOTOS (THUMBNAILS)

The Seller is obliged to present the Goods on at least one photo (thumbnail) placed on the server belonging to Goelectric.pl. This photo must meet the following requirements:

  1. The presentation of the Goods in the photo must be in such a form and form that it does not raise doubts as to the actual and real object of sale under a given Offer.
  2. The goods should be presented on a white, uniform background (RGB 255.255.255). The exception is books, films, music and software, the cover of which can fill the entire surface of the photo and photos in the "Clothing" category, as well as in Offers published under the GO ELECTRIC Marek Zone, for which separate agreements with entities cooperating with Goelectric.pl may specify conditions for the presentation of the Goods differently. The thumbnail cannot contain any additional elements, in particular texts, graphic elements, frames, logos, etc., with the reservation that the logotype may be placed only in the case of photos in the Offers published within the GO ELECTRIC Brands Zone.
  3. If the photo of the Product does not allow the presentation of its essential features (color, taste, smell), it is allowed to define them graphically on the thumbnail.
  4. It is allowed to present the Goods in the context of its use or arrangement.
  5. It is permissible to present a technical drawing related to the offered Goods in a photo (thumbnail).

Section 3. ADDITIONAL OPTIONS

When creating the Offer, the Seller is offered the following additional options for a fee:

  1. highlighting a product or company as a banner on the home page,
  2. distinction as a miniature logo among manufacturers and suppliers,
  3. other awards offered individually.

Article 4. MESSAGE TO THE BUYER

The seller may, under the confirmation referred to in art. 7.4 of the Regulations, provide additional information related to the conclusion of the contract. This message may not violate applicable law or the Regulations, in particular contain:

  1. Website addresses (in any form, e.g. references, links) through which commercial activities are carried out;
  2. Advertisements, promotional and announcement content and other elements facilitating the purchase of goods and services outside GO ELECTRIC ;
  3. Information contradicting the content of the Offer.

Appendix No. 3 - Technical breaks

Appendix no. 3. Policy of technical breaks and compensation for technical failures

Article 1. TECHNICAL BREAKS

  1. In order to develop GO ELECTRIC and minimize the risk of failure, Goelectric.pl carries out periodic technical breaks, during which changes are introduced in the IT system. These breaks take place, if possible, at night, i.e. from 10.00 pm to 8.00 am, and the Users are informed about the date and expected length of their duration at least several hours in advance.

Article 2. TECHNICAL FAILURES

  1. A technical failure is considered to be a situation in which most or all Users at a given moment, due to problems related to the GO ELECTRIC IT system, lost the ability to use the basic functions of GO ELECTRIC , in particular, they could not log in, search and use the Offer.

Article 3. TECHNICAL ERRORS

A technical error is considered to be any technical problem related to the functioning of the GO ELECTRIC IT system other than that indicated in art. 2 above. The decision on possible compensations and returns is made by Goelectric.pl each time a technical error is removed, taking into account its type, duration and scale of negative effects.

PART I. GENERAL REMARKS

  1. Goelectric.pl charges the following fees and commissions for services related to the organization of the Transaction provided under Goelectric.pl:
    a. commissions (6%) on sales from Sellers, but not more than PLN 100 (see point 6)
    b. fees for additional options (optional)
  2. When the product has been returned by the Buyer, the fees referred to in point a are subject to compensation in certain situations (cf. Part VI). The fees listed in point b of the above point, they are refundable when the Seller has suspended the listing of the product and the fees have exceeded this date. One-off fees for additional options are not refundable, unless the Seller withdraws sufficiently early without risking it GO ELECTRIC for additional costs. Details of the billing are included in the following sections of this Annex.
  3. Goelectric.pl does not charge fees or for listing sales offers on GO ELECTRIC nor for services GO ELECTRIC ESCROW or POK (Buyer Protection Program); it may, however, charge you for other services provided under GO ELECTRIC. The amount of these fees is specified each time in the regulations of a given service.
  4. All amounts in this Annex are gross amounts (including value added tax, ie VAT). If the amount of the fee or commission is determined as a percentage of a given amount (e.g. selling price), the gross amount (including VAT) is used as the basis for determining this fee or commission. The commission amounts are rounded up to the nearest pennies.
  5. It is unacceptable for the Seller to charge the Buyer with the costs of the Transaction directly.
  6. The commission mentioned in point 1 is not charged during the first sale and it decreases to 5.5% when selling 10 products per month and to 4.9% when selling 100 products per month.
  7. GO ELECTRIC it never charges any Buyer fees.

PART II. SALE COMMISSIONS

  1. The sales commission is charged each time the auction is confirmed or purchased by Buy It Now or purchased by Add to Cart.
  2. The amount of the commission depends on the final price (not including delivery costs).
  3. The minimum value of a commission charged once for each piece is PLN 0.25.
  4. In the event of removing a multi-item Offer only with the Buy Now option or terminating it prematurely on the terms described in art. 8.2. Of the Regulations, the commission on sales is calculated on the sold items of the Goods until the Offer is removed or completed.
  5. Sales commissions are charged on the terms described below:

PART III. CHARGES FOR ADDITIONAL OPTIONS

  1. The User may choose additional options allowing to determine a specific way of presenting the page with the content of the Offer and its promotion in GO ELECTRIC.
  2. The fee for each additional option is charged at the time of publication of the Offer, and in the case of a later selection of a given option - at the time of its application.
  3. Fees for additional options are collected on the general terms described in section A below.
  4. In the event of removal of the Offer or termination of it prematurely on the terms described in the Regulations, the fees for additional options shall be refunded in the amount reduced by the amount proportional to the time during which the Offer was published in GO ELECTRIC.
  5. An additional option is also an audit carried out by GO ELECTRIC. The sellers can ship the goods to GO ELECTRIC in order to assess its quality and obtain the quality label and / or credibility visible on the pages GO ELECTRIC.
  6. Fees for additional options will be charged according to the price list below.

5000 PLN for 1 hour, in which you will receive all our experience and avoid mistakes in your business, which are often very expensive. This is especially true for startup companies, most of which fail due to wrong decisions.

Organization of container import of individual sellers

Depends on the number of sellers and the type of products. On average, PLN 500-1500 per seller + normal transport, customs and tax fees, etc., divided by the number of sellers.

PART IV. ANNOUNCEMENTS IN THE CATEGORY OF SERVICES, WORK AND RENT

  1. Advertisements are otherwise offers without prices in the categories of Services, Work and Rental, which are used only for advertising purposes, and not for the conclusion of a sales contract by GO ELECTRIC. You can also submit bids for purchase via these categories GO ELECTRIC (like other products), which then are not treated as advertisements, but as other products (offers with prices), and therefore their listing is free, only a commission on sales is charged and optional fees for additional options.
  2. Ads can only be posted in the categories Services, Jobs and Rentals.
  3. All ads are free of charge, but Users should always try to reformulate their ads into purchase offers, i.e. offers with prices to be purchased by GO ELECTRIC displayed like any other product. Ads that are clearly marketable will not be accepted. An example of an advertisement that should be put up as an offer for sale by GO ELECTRIC is to rent an electric bike, e-scooter or other e-vehicle.

PART V. SETTLEMENTS

A. Settlements of receivables

  1. For each User, settlements are carried out separately for each Account.
  2. Settlement management takes place after logging in, where each User can view the account balance (charged fees and commissions and the amount of returns, i.e. the balance of settlements). The user may obtain detailed billing data upon request to Goelectric.pl via the form available on the website GO ELECTRIC.
  3. After the end of a given billing period, the User is obliged to pay the amount due to Goelectric.pl by the 14th day of the following month.
  4. Users receiving invoices are required to pay the amount due indicated in this invoice within the time limit indicated in the invoice. Regardless of the invoice issued, at the end of the billing period, the User receives information via e-mail about the amount due.
  5. Failure to pay the amount due within the required time limit may result in partial or complete loss of the functionality of the User Account. In this case, the condition for restoring the full functionality of the Account is the payment of all amounts due to Goelectric.pl.
  6. Payments for Goelectric.pl are made to one of the bank accounts GO ELECTRIC available in Annex 7C.

B. Overpayments

  1. In the event of an overpayment under the Account, the User may at any time request its return using the appropriate form, with the proviso that the overpayment on the Account will first be credited to the currently charged fees and commissions and any debt on other Accounts of a given User. The overpayment is returned to the entity making the payment by bank transfer.
  2. The reimbursement of the overpayment will be reduced each time by 50gr of the handling fee, calculated on the amount of the overpayment requested by the User, subject to point 3 below.
  3. Funds from payments related to Goelectric.pl promotions are not refundable and are not included in the overpayment amount requested by the User and can only be used in full to settle future obligations resulting from the User's use of the services GO ELECTRIC.
  4. The handling fee referred to in point 2, is not charged in the event that the refunded overpayment was due to reasons attributable to Goelectric.pl.
  5. In the event that the reimbursement of the overpayment on the Account is connected with the issuance of a correcting invoice for the User, the condition for its making is that the User sends a copy of the correcting invoice to the address of Goelectric.pl with confirmation of its receipt.

C. Changes in the amount of fees and commissions

  1. Goelectric.pl reserves the right to change the amount of fees and commissions. These changes take place in the manner and on the terms set out in the Regulations.
  2. Goelectric.pl reserves the right to periodically reduce fees and commissions as part of time-limited promotions - on terms provided for separately for such actions.

D. Invoices

  1. Company Account Users, in order to receive invoices, should complete the appropriate form and pass the verification of the data provided in the invoice form. The data for invoices must be consistent with the data provided in the Account settings. Invoices for the following months will be issued automatically without the need to repeat the actions indicated in the previous sentences - until the User resigns from receiving invoices.
  2. Users - natural persons not conducting business activity, invoices are issued only at their request. In this case, the provisions of sec. 1 shall apply accordingly.
  3. A user who is a value added tax (VAT) taxpayer with a seat in the territory of a European Union country other than Poland is obliged to submit documents confirming his registration as a taxpayer in one of the European Union countries other than Poland and complete the appropriate form. Documents confirming the taxpayer's registration and the data provided in the form are verified.
  4. Invoices for a given month include the receivables accrued in that month and are issued no later than by the 15th day of the following month.
  5. The user is obliged to update the invoice data immediately after each change. In the case of updating invoice data (except for contact details), the change is possible only in the event of a transformation of the company or other form of legal succession. The change takes place after the documents confirming the legal succession are verified.
  6. The default form of sending invoices is to make them available in electronic form. Acceptance of the Regulations constitutes at the same time acceptance for sending (sharing) invoices in electronic form, within the meaning of the provisions on tax on goods and services, on the terms described in the Regulations.
  7. To ensure the authenticity of the origin of invoices within the meaning of separate regulations, invoices will be made available to the User in electronic form only after logging in to his Account, using a login and password, in a way that allows them to be downloaded to the User's IT system.
  8. To ensure the integrity of the content of invoices within the meaning of separate regulations, invoices made available in electronic form will be generated as files in PDF (Portable Document Format) format, secured in a way that prevents the invoice data from being changed, in particular:
    a.editing the content of the document,
    b. commenting,
    c. filling in or signing form fields,
    d. document assembly,
    e. copying the content of the document,
    f. extracting pages.
  9. Goelectric.pl reserves the right to use additional technical solutions beyond those indicated in points 7 and 8 above, aimed at ensuring the authenticity of origin and integrity of the content of invoices sent (made available) in electronic form.
  10. The user may at any time withdraw his acceptance of sending (sharing) invoices in electronic form by submitting such a request to https://goelectric.pl/en/ via the contact form. The following are also considered as withdrawal of acceptance for sending (sharing) invoices in electronic form:
    a. resignation from receiving VAT invoices, made by the User after logging into his Account and closing the Seller's account,
    b. submitting a statement on termination of the Agreement by either party.
  11. A User who has withdrawn his acceptance of sending (sharing) invoices in electronic form may re-accept by checking the appropriate box in his Account settings.
  12. Acceptance to send (make available) invoices in electronic form, as well as withdrawal of acceptance take effect from the moment they are made.
  13. The user who receives VAT invoices sent (made available) in electronic form is obliged to store them in accordance with separate regulations.
  14. Goelectric.pl reserves the right to issue and send the User a paper invoice, despite the User's acceptance of the sending (sharing) of invoices in electronic form.

PART VI. PROCEDURE FOR GRANTING A TRANSACTION DISCOUNT (reimbursement of the value charged or the commission charged)

  1. In particularly justified and beyond the control of the Seller cases, where the Seller has concluded a sales contract, but it is not possible to receive a benefit from the Buyer, GO ELECTRIC may grant the Seller a transaction discount for the provision of services under GO ELECTRIC in the current billing period or in subsequent billing periods.
  2. The amount of the transaction discount may not exceed the amount of the commission on the sale of the Goods, which was previously charged or collected by Goelectric.pl in connection with the conclusion of the sales contract referred to in paragraph 1.
  3. In order to receive a transaction discount, the Seller should complete the appropriate form available on the relevant page GO ELECTRIC, within 45 days from the conclusion of the sales contract.

Part I. Scope of Application

Tartaczna 5, 26-600 Radom (for convenience, hereinafter referred to as: " GOELECTRIC.pl " or " GO ELECTRIC "), being the operator of the trading platform available at www.https://goelectric.pl/en/ (hereinafter referred to as: " GO ELECTRIC " for ease of use) is the administrator within the meaning of the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (for convenience, we will continue to use abbreviation " GDPR "), in relation to personal data of Users who are natural persons. This means that GOELECTRIC.pl determines the purposes and methods of processing Users' personal data on its own and on its own responsibility. In case of questions or doubts as to how your personal data is protected by GOELECTRIC.pl, contact GOELECTRIC.pl (the e-mail address is in part IX of this document). Personal data is any information that can identify you, for example your name and surname, telephone number, e-mail address and the address for delivering purchases made on the GO ELECTRIC platform to you. When we refer to the term "process" or "processing" in the following document, we mean all activities and operations performed on your personal data (eg storing or analyzing it for the purpose of providing you with a service).
  2. The purpose of this Privacy Policy is to define the activities undertaken by GOELECTRIC.pl in the field of the protection of personal data processed, including those collected via the GO ELECTRIC trading platform and the mobile application as well as related services and tools used by Users to perform activities such as Registration, posting or viewing Offers and performing a number of other activities related to the above in connection with the Users' use of GOELECTRIC.pl services. All our activities are subject to legal provisions in the field of data protection, for example GDPR. Our Privacy Policy is governed by Polish law and complies with the GDPR.
  3. Your use of GO ELECTRIC , including the download of a mobile application or the use of related services and tools, is possible only after reading the provisions of this Privacy Policy and the GO ELECTRIC Regulations.
  4. By clicking on the links posted on the GO ELECTRIC platform or the mobile application, you may be redirected to websites or services that constitute a service provided by entities other than GOELECTRIC.pl and thus beyond our direct or indirect control, in which the processing , including the collection of personal data, takes place in accordance with the principles set out by these entities, e.g. in the privacy policy applicable to these services or applications, in particular in the cases specified below.

Part II. Processing of personal data by GOELECTRIC.pl, including their collection and storage

Below, we have described the most common activities on Users' personal data, i.e. also on your personal data in connection with the use of GOELECTRIC.pl services.

  1. Account data and profile data : creating an Account by the User may require providing information identifying the User, including his contact details. Such data may include, for example, the User's first and last name, his e-mail address and correspondence address. According to their choice, Users have the option of creating a profile under the Account, which may also contain other data, for example the User's location, first and last name, telephone number and photos posted by the User on the GO ELECTRIC platform. The profiles created as part of the Account may be used by Users for mutual contacts, for example if they are interested in an offer made available on the GO ELECTRIC platform, including epojazd.pl. Users can share their personal data and other information on their public profiles (i.e. profiles that can be accessed by anyone who uses the Internet), based on their own, deliberate and informed decision. The user should carefully consider the risks that may be associated with such disclosure of personal data, in particular the address or exact location. Such a risk may be, for example, the possibility of identification of the User by other persons, loss of some privacy, and in extreme cases even identity theft. When logging in to GOELECTRIC.pl via an external authentication service offered by entities on which GOELECTRIC.pl has no control, e.g. Facebook Connect, GOELECTRIC.pl as part of the GO ELECTRIC platform obtains data only in the form of the User's e-mail address and only for such logging.
  2. Transactions : GOELECTRIC.pl as part of the GO ELECTRIC platform may process (for example, store or analyze) information constituting the User's personal data, enabling the Buyer and Seller to conclude a contract, send messages, communicate with other Users and make payments for services provided by GOELECTRIC. pl as part of the GO ELECTRIC platform, including at epojazd.pl. Some of the data necessary to issue an Offer will also be required to create an Account. The information posted by the User in Offers and "Messages to the Buyer" does not come from GOELECTRIC.pl and is not initiated by GOELECTRIC.pl. For this reason, to the fullest extent possible under the applicable law, GOELECTRIC.pl is not responsible for the information provided as part of the Offers and "Messages to the Buyer".
  3. User service : GOELECTRIC.pl as part of the GO ELECTRIC platform, including at epojazd.pl, may collect and otherwise process (e.g. store or analyze) personal data of Users contacting the User's service department. These data may be necessary to communicate with the User (e.g. to answer the questions asked by him), but also to fulfill his request. Contact will also be possible through the use of data stored for this purpose on the User's Account. If it is allowed under applicable law, GOELECTRIC.pl will also be entitled to obtain (and otherwise process, for example, storage) other personal data regarding communication with Users, e.g. information about requests for support or feedback from Users. .
  4. Contact form : GOELECTRIC.pl as part of the GO ELECTRIC platform may collect personal data of Users contacting GOELECTRIC.pl and the Sellers via the available tools, including the contact form available on the GO ELECTRIC platform. These data are necessary to enable GOELECTRIC.pl to contact Users, but also to enable Users to contact other Users for purposes related directly to the functioning of the GO ELECTRIC platform, for example in connection with the conclusion of a sales contract as part of transactions made on the GO ELECTRIC platform, in including epojazd.pl. The contact form provided by GOELECTRIC.pl is not used for private correspondence not related to the implementation of the Transaction and using it for such purposes may constitute a violation of the GO ELECTRIC Regulations. In order to counteract violations of the law, including unfair practices, GOELECTRIC.pl collects data on communication made via the above-mentioned form, GOELECTRIC.pl may also analyze and block, using special software, the content of messages sent between Users, via the above-mentioned contact form, in particular if are spam (unsolicited advertising information), contain prohibited content (e.g. encouragement to commit crimes) or otherwise threaten Users' security (e.g. they are intended to obtain an Account password unlawfully).
  5. Data collected by the website and mobile devices : When it is necessary to provide the service to Users or is a legitimate interest of GOELECTRIC.pl or third parties (which is, for example, ensuring the security of IT resources or the security of other Users), GOELECTRIC.pl is entitled to automatically obtaining and recording data transferred to the server by web browsers or Users' devices. Such data may include, for example, the IP address (i.e. the address used by the User's device used to access the GO ELECTRIC platform), parameters of the software and hardware used by the User (thanks to which we can improve e.g. the quality of our services), pages, identification number of the mobile device, information about the use of the application and other data regarding devices and system use. The collection of the above information will take place when using the GO ELECTRIC website or mobile application.
  6. Surveys : Additionally, and only with the consent of the User, occasionally, by way of surveys sent to Users via e-mail or made available directly at GO ELECTRIC , GOELECTRIC.pl collects personal data from Users, which may, for example, include age. These data are used to test Users' preferences and adjust the GOELECTRIC.pl offer to their expectations, as well as for statistical analyzes. Granting consent to receive the questionnaire, as well as its completion and return to GOELECTRIC.pl is always voluntary, and the User may at any time opt out of receiving the questionnaires in the same way as he agreed to receive them.
  7. Contests : Contests are organized GO ELECTRIC from time to time. Users' personal data (e.g. contact details) who will take part in the competition may be used by GOELECTRIC.pl to conduct it efficiently, e.g. to notify about the victory.
  8. Promotional campaigns : Occasionally, GO ELECTRIC organizes promotional campaigns. Contact details of Users who voluntarily take part in promotional campaigns are processed by GOELECTRIC.pl in accordance with the law and for purposes related to the promotion. The user may at any time opt out of receiving information about promotions in the same way as he entered the competition or promotion.

Part III. IP address, cookies and identification numbers of mobile devices

  1. Like many other websites offering very different services provided electronically, GOELECTRIC.pl may collect data as part of the GO ELECTRIC platform services through such technologies as cookies, tracking pixels and objects made available locally (e.g. in a browser or on a device).   2. GO ELECTRIC mobile application uses the Google Account service to authenticate the User's device and confirm his identity. During the authentication and verification process, no User's data is transferred to the operator of this service.

Part IV. Use of collected data

  1. GOELECTRIC.pl processes (e.g. collects, stores, analyzes, etc.) personal data of Users in GO ELECTRIC for the following purposes:
    1) enabling full use of the GO ELECTRIC platform,
    2) providing support for the User's Account and Transactions on the GO ELECTRI platform, including solving technical problems;
    3) setting up and managing an Account or User Accounts;
    4) adjusting the content of the displayed offers by the GO ELECTRIC platform or services of external entities based on the User's activity on the GO ELECTRIC platform;
    5) monitoring of Users' activity, including, inter alia, searched keywords, placed Offers and traffic management on the GO ELECTRIC platform;
    6) contacting Users, including for purposes related to the provision of services, User service, permitted marketing activities, through available communication channels, in particular e-mail and telephone;
    7) conducting research and analyzes of the GO ELECTRIC platform, inter alia, in terms of the functioning of the platform, improving the operation of available services or estimating the main interests and needs of visitors;
    8) ensuring the security of electronic services, including enforcement of the GO ELECTRIC Regulations and counteracting fraud and abuse;
    9) performance of contracts concluded under the sales contract with other Users on the GO ELECTRIC platform, as part of own sales conducted by GOELECTRIC.pl only in the scope of data obtained in connection with the conclusion of the contracts in question;
    10) performance of surety agreements under the Buyer Protection Program;
    11) handling complaints on the GO ELECTRIC platform and in the Official GO ELECTRIC Store;
    12) matching advertisements in accordance with previously viewed content;
    13) conducting direct marketing of own GOELECTRIC.pl services, goods of the Official GO ELECTRIC Store or services or goods of third parties;
    14) handling Users' requests, in particular, to the user service department and via the contact form;
    15) organization of loyalty programs, competitions and promotional campaigns in which Users may participate;
    16) performance of obligations resulting from legal regulations, including tax or accounting regulations;
    17) providing payment services, commission payments for transactions on the GO ELECTRIC platform or for goods sold in the GO ELECTRIC Official Store, debt collection;
    18) support for credit services;
    19) support for insurance of the purchased goods;
    20) conducting court, arbitration and mediation proceedings;
    21) statistical;
    22) archiving;
    23) ensuring accountability, i.e. the ability to demonstrate that:
    a) personal data are processed in accordance with the law, fairly and transparently for the data subject,
    b) the purpose of data processing is clearly specified,
    c) the processed data are adequate, relevant and limited only as to the purposes of their processing,
    d) personal data is correct and, if necessary, updated,
    e) personal data is processed in a manner ensuring adequate security,
    f) and that the storage of the data is limited to the strict minimum necessary to achieve the purposes for which they are processed.
  2. GOELECTRIC.pl is entitled to store the data collected and tracked on the GO ELECTRIC platform only in the scope of the above-mentioned business purposes.

Part V. Data sharing

  1. GOELECTRIC.pl does not transfer Users' personal data to third parties without the consent of the Users concerned. If it is in accordance with the consent of the User or the legitimate interest of GOELECTRIC.pl, GOELECTRIC.pl may provide Users' personal data to other websites operated by GOELECTRIC.pl. In this case, each of the Users whose personal data has been shared will be informed in detail.
  2. GOELECTRIC.pl may cooperate with third parties (e.g. specialized providers of data storage services or analytical services) in order to provide us with services by these entities. In this case, these entities are not authorized to use Users' personal data for their own purposes (the data will always be processed on behalf of and for the purposes of GOELECTRIC.pl), and their activities are subject to the provisions of applicable law and this Privacy Policy;
  3. GOELECTRIC.pl may share Users' personal data with public authorities supporting GO ELECTRIC in the fight against fraud and abuse at GO ELECTRIC , including in connection with ongoing proceedings regarding possible violations of the law or combating other possible violations of the GO ELECTRIC Regulations.
  4. As part of the adopted Privacy Policy, GOELECTRIC.pl undertakes not to sell Users' personal data. In the event of restructuring or sale of the business or its part, and the transfer of all assets or a significant part thereof to a new owner, the Users' personal data may be transferred to the Buyer in order to ensure the continuation of the service under GO ELECTRIC .
  5. With the consent of the User, GOELECTRIC.pl may share Users' personal data with public benefit organizations in order to enable them to thank the User for the payment made.
  6. Due to the need to prevent the performance of certain functions on the GOELECTRIC.pl platform by internet robots, we use the Google reCAPTCHA mechanism to sporadically test whether the behavior of the platform users does not bear the characteristics of robots. For this reason, GO ELECTRIC may disclose Google Inc. Your IP address.
  7. GOELECTRIC.pl may share anonymised data (i.e. those that do not identify specific Users) to external service providers, trusted partners or research agencies in order to better recognize the attractiveness of advertisements and services for Users, improve the overall quality and effectiveness of services provided by GO ELECTRIC or the entities mentioned. or participation in scientific research that brings broadly understood social benefit.
  8. Sellers to whom the GDPR applies, after obtaining the Buyers' personal data from GOELECTRIC.pl, are obliged to fulfill all obligations to Buyers under the GDPR and other legal provisions, including ensuring that they exercise their GDPR rights.

Part VI. Implementation by the User of the rights under the GDPR

  1. We have prepared a special instruction of conduct for Users who would like to exercise their rights granted to them by the GDPR. This document describes in detail how Users can exercise their rights against GOELECTRIC.pl. and it is available at this link .
  2. Moreover, a User who exercises the right to object to him / her by the GDPR should log out of all devices and delete cookies (in some cases, the process may take up to 48 hours). Instructions for deleting cookies are available in the Cookie Policy at this link .

Part VII. Security

All data collected by GOELECTRIC.pl is protected using rational technical and organizational measures and security procedures in order to protect them against unauthorized access or their unauthorized use. Entities related to GOELECTRIC.pl, trusted partners and external service providers manage data in accordance with security and privacy protection requirements.

Part VIII. Change of provisions

If necessary, GOELECTRIC.pl may change the provisions of this Privacy Policy. In this case, Art. 14 section 2 of the GO ELECTRIC Regulations shall apply accordingly.

Appendix No. 6. Junior account rules

  1. Natural persons who are 13 years of age but under 18 years of age, and may be Users, for the purpose of Registration should complete the appropriate form, in which they additionally provide the date of birth.
  2. During the Registration, the Junior Account User declares that he concludes contracts under GO ELECTRIC with the consent of the legal guardian.
  3. The account of such a User will be marked with an icon visible to all visitors of GO ELECTRIC .
  4. User of the Junior Account or persons who are obliged by law or contract to supervise it, are responsible for the actions of the Junior Account User under GO ELECTRIC , in particular they are fully liable for damages to GOELECTRIC.pl and third parties.
  5. The Junior Account User does not have access to all services offered as part of GO ELECTRIC , in particular:
    a.can not use the services of:
  • Sales manager;
  • GO ELECTRIC stores;
  1. b. cannot activate the option of receiving invoices for services offered under GO ELECTRIC ;
    c. may not purchase or sell Goods under Transactions placed in the following categories:
    • Real estate;
    • Cars;
    • Motorcycles;
    • Other vehicles and boats;
    1. Due to the fees and commissions charged for the use of GO ELECTRIC , in the current settlement period, i.e. a given calendar month, the negative balance of the Junior Account User on the settlement account may not exceed the amount of PLN 50.
    2. The restrictions on the Junior Account referred to in points 5 and 6 above will be lifted:
      a.automatically - when the Junior Account User reaches 18 years of age,
      b. at the documented request of the Junior Account User - after he or she reaches the age of majority in other cases provided for by law.

    Annex No. 7A: GO ELECTRIC ESCROW

    Annex 7A: Regulations of the GO ELECTRIC ESCROW service

    These Regulations define the rules for making payments by Buyers and withdrawals by Sellers who make Transactions under GO ELECTRIC .

    ARTICLE 1. TERMS AND CONDITIONS OF PROVIDING THE SERVICE

    1.1. Information on the entity providing the GO ELECTRIC ESCROW Service

    The entity providing the payment service, hereinafter referred to in these regulations as " GO ELECTRIC ESCROW service", for Users is GO ELECTRIC Marcin Bogdanowicz, ul. Tartaczna 5, 26-600 Radom, entered into the Central Register and Information on Economic Activity under the NIP number: 7961895421 and REGON: 147335650, hereinafter referred to as " GO ELECTRIC ".

    Description of the basic features of the GO ELECTRIC ESCROW Service

    1.2. The GO ELECTRIC ESCROW service is a payment service for the acceptance by GO ELECTRIC of funds provided by the Buyer (for the purposes set out in point 1.4 and using the payment channels available to the Buyer to pay for the Goods, which are recorded under the billing tool maintained by GO ELECTRIC for the Seller.The condition for the transfer of the payments referred to above is the existence of a pecuniary obligation resulting from the agreements concluded between the Sellers and the Buyer as part of the Transaction.

    1.3. The contract for the provision of the GO ELECTRIC ESCROW Service on the terms set out in these regulations is concluded when the Buyer's account is opened at Goelectric.pl.

    1.4 The GO ELECTRIC ESCROW service is a payment from the Buyer to the Seller stored by GO ELECTRIC for a period of 28 days (4 weeks) from the delivery of the goods in the event of non-delivery or delivery of a defective product. Problems with the product or shipment are first reported by the Buyer to the Seller. If it is not resolved, GO ELECTRIC , after considering all the evidence, decides and returns the money to the Buyer or Seller, respectively. For this purpose, the buyer should report the problem to GO ELECTRIC within 28 days from the delivery of the goods. In the event of non-delivery or replacement of the product, the GO ELECTRIC ESCROW service period is extended by a further 14 days from each new delivery. GO ELECTRIC reserves the right to any extension of the time to resolve the conflict and report the case to the relevant law enforcement authorities in the event of a crime.

    1.5 The GO ELECTRIC ESCROW service is provided with the help of payment channels, hereinafter referred to as the Payment Operator, made available to buyers when executing the basket. The list of payment methods and electronic and installment payment operators with which GO ELECTRIC cooperates is included in Annex 7B. The buyer's payments go to the bank account of GO ELECTRIC , where they are stored for a sufficiently long time (Article 1.4), and then transferred to the bank account of the Buyer or Seller.

    Responsibility of the Parties

    1.14. GO ELECTRIC orders a transfer of the payment reduced by fees and commissions (Annex 4) immediately after the GO ELECTRIC ESCROW service referred to in art. 1.4.

    1.15. GO ELECTRIC not responsible for delays in transferring due funds to the bank account or address indicated by the User on the terms set out in Article 5 due to failure to provide or providing incorrect or incomplete data by the User, which prevent the execution of a bank transfer or postal order.

    1.16. GO ELECTRIC is not a party to the contract concluded between the Buyer and Sellers and is not responsible for improper performance or non-performance of contracts concluded by Users, with the exception of activities covered by the GO ELECTRIC ESCROW Service. GO ELECTRIC , in particular, is not responsible for the ability of the Sellers to conclude and perform the contract for the sale of goods or services and the solvency of the Buyers.

    Statuses of the GO ELECTRIC ESCROW Service implementation

    1.17. Information on the state of implementation of the GO ELECTRIC ESCROW Service and information necessary to identify payment transactions carried out for the User, and payments ordered in the manner specified in Article 5, are available as part of the Account kept for the User at GO ELECTRIC , and are also provided by GOELECTRIC.PL and The payment operator to the e-mail address provided by the User. The information referred to above is made available in a way that allows the Seller to store and reproduce this information unchanged.

    Unauthorized payment transactions

    1.18. In order to avoid making unauthorized payment transactions, the User is obliged not to disclose identification data (login, password) to third parties.

    1.19. The User is obliged to immediately report to GO ELECTRIC and the Payment Operator about the loss or unauthorized use of identification data enabling the submission of a payment order. Reports must be made in the manner specified in Article 1.21 within 13 months from the date of execution of any unauthorized or improperly executed payment transactions, or from the date on which the payment transaction was to be performed. If the User fails to submit the notification within the aforementioned period, the User's claims against the Payment Operator for unauthorized, non-performed or improperly performed payment services shall expire.

    Contact with the Payment Operator

    1.20. The language in which GO ELECTRIC communicates with Users is Polish. All documents shaping relations with Users are formulated in this language.

    1.21. All correspondence of the User should be sent in writing to the following address: GO ELECTRIC or in electronic form via the website: https://goelectric.pl/en/contact-us . All correspondence should contain at least the name under which the User appears in GO ELECTRIC and a description of the application. Correspondence by electronic means, as a rule, takes place using the e-mail address assigned to the Account of a given User.

    1.22. At the request submitted by the User in the manner specified in Article 1.21, these regulations are provided in writing (paper).

    Costs related to the use of the GO ELECTRIC ESCROW Service

    1.23. The User shall not bear any additional costs of the payment of the GO ELECTRIC ESCROW Service by the Operator, except for separate payment orders in a specific form indicated in Articles 5.6 and 5.7. The User is obliged to pay fees related to the implementation of the GO ELECTRIC ESCROW Service under contracts concluded by the User with payment service providers (bank or authorization and settlement center), as well as to bear the costs of data transmission via the Internet related to the use of the GO ELECTRIC ESCROW Service.

    1.24. Each User has permanent access under the Account in GO ELECTRIC to an electronic list of operations related to the GO ELECTRIC ESCROW Service concerning that User.

    ARTICLE 2. VERIFICATION PROCEDURE

    Verification procedure

    2.1. The User acknowledges that as part of the GO ELECTRIC ESCROW Service, the financial credibility qualification is carried out in accordance with art. 10 of the Payment Services Act, and therefore it is possible to differentiate the rules of payment processing or make certain terms of service conditional depending on the User's qualification to a given risk group. GO ELECTRIC performs the above analysis of the payment service risk based on the data available when performing the GO ELECTRIC ESCROW Service. In justified cases, GO ELECTRIC reserves the right to refuse to handle a given payment in case of doubts as to the legality of the transaction for which the payment is made or the legality of the payment itself. GO ELECTRIC shall not be liable for damages incurred by the User due to the refusal referred to in the previous sentence.

    2.2. GO ELECTRIC reserves the right to discontinue the provision of the GO ELECTRIC ESCROW Service to the User in the event of blocking his Account or taking actions referred to in art. 2.13 or 8.2. Of the GO ELECTRIC Regulations. GO ELECTRIC may also block the settlement tool in the following cases:

    a.changing the User's data, in particular the bank account number,

    b. out of date or incorrect data necessary for the execution of the payment order,

    c. as a result of a notification or decision of an authorized body,

    d. suspected money laundering. In this case, GO ELECTRIC notify the General Inspector of Financial Information (GIFI) and then will act in accordance with the GIFI guidelines.

    2.3. The User acknowledges that the used payment instruments (in particular a payment card) may be used only by its authorized holder, i.e. a person authorized to use a given instrument under an agreement with its issuer. Detected violations of the law are reported to the competent law enforcement authorities.

    2.4. A user who wants to sell on https://goelectric.pl/en/ is obliged to undergo the identification referred to in the Act on counteracting money laundering and terrorist financing, as amended), hereinafter referred to as "Seller's Identification". For this purpose, he should top up the bank account indicated by GO ELECTRIC with the amount of PLN 1.01 from the User's bank account referred to in Article 5.2. The above amount is fully refunded by GO ELECTRIC to the User's bank account from which it was paid or added to the amount of the first withdrawal referred to in Article 5. The Payment Operator may also perform User Identification on the basis of another procedure provided for by law. The provisions of this article shall apply accordingly to changes by the User of the bank account referred to in articles 5.2 and 5.3.

    2.5. The User is obliged to comply with applicable law, as well as the rules of conduct and procedures set out by GO ELECTRIC and the Payment Operator, in order to ensure compliance with the law and the rules set out by the relevant payment card organizations.

    ARTICLE 3. GO ELECTRIC ESCROW SERVICE FOR BUYERS

    Special rules for the provision of the GO ELECTRIC ESCROW Service for Buyers

    3.1. GO ELECTRIC by providing the GO ELECTRIC ESCROW Service to the Buyer, transfers the received funds to the Seller by posting them as part of the settlement tool. The GO ELECTRIC ESCROW service for the Buyer is provided no later than by the end of the next business day from the moment the payment order is received by the Payment Operator from the Buyer. The moment of receipt of the payment order by GO ELECTRIC is the moment when the GO ELECTRIC bank account was credited with the payment amount for the Goods provided by the Buyer. The Buyer may not revoke the payment order from the moment it is received by the Payment Operator.

    3.2. GO ELECTRIC provides the GO ELECTRIC ESCROW Service on the basis of a payment order submitted by the Buyer, the submission of which takes place through an ordinary shop order on the https://goelectric.pl/en/ website (it is possible to submit multiple payment orders to multiple Sellers at the same time). GO ELECTRIC not receive the payment within 10 days from the date of submitting the payment order, the order obtains the "canceled" status.

    3.3. GO ELECTRIC as part of the GO ELECTRIC ESCROW Service provides the Buyers with the following payment channels supported by payment service providers:

    a. electronic transfers, including non-cash payments in Polish money,

    b. traditional transfers made outside the Internet or other electronic transfers,

    c. using payment cards, covering non-cash payments in Polish money made with payment cards that have been approved by banks for transactions in the Internet environment, in the case of payment for Goods in selected categories,

    other methods made available by the Payment Operator, enabling the performance of Buyers' obligations towards Sellers.

    3.4. The minimum and maximum amount of operations under the GO ELECTRIC ESCROW Service may be determined in relation to a given Buyer by the appropriate bank, authorization and settlement center or the Payment Operator.

    3.5. In addition, the GO ELECTRIC ESCROW Service allows the Buyer, among others:

    a. storing and changing your personal and address data,

    b. access to the history of payments made to the Sellers,

    c. access to payment statuses ("started", "canceled", completed "),

    d. an additional payment order if the payment made to the Seller was inconsistent with the costs of purchasing the Goods agreed with the Seller.

    ARTICLE 4. PAYOUT RULES

    Special rules for the provision of the GO ELECTRIC ESCROW Service for Sellers

    4.1. GO ELECTRIC by providing the GO ELECTRIC ESCROW service to the Seller, runs a settlement tool for the Seller and, at the Seller's request, initiates a transfer of the collected funds to the bank account indicated by the Seller or initiates the payment of funds by postal order under the conditions specified in Article 5.7. As part of the GO ELECTRIC ESCROW Service, the payment Operator accepts, as part of the Seller's billing tool, payments made by Buyers in connection with Transactions made under GO ELECTRIC and other websites operated by Goelectric.pl outside Poland.

    4.2. The GO ELECTRIC ESCROW service also enables the Sellers to:

    a.access to information about the history of payments made by Buyers,

    b. access to information on the status of the withdrawals initiated by the Seller ("started", "canceled", "completed"),

    c. return to the Buyer of the funds paid by him, until the payment is ordered, and the refund may be ordered within 12 months of making the payment.

    4.3. In the event of failure to complete or incomplete completion of the configuration form referred to in Article 5.3. or in the event of the impossibility of identifying referred to in Article 5.3., the Seller may not raise an objection to the Buyer of non-payment for the Goods, if the funds directed by the Buyer to the Seller to pay for the Goods have been fully booked as part of the settlement tool.

    4.4. The seller who correctly and completely completed the configuration form on the GO ELECTRIC websites, in My Account / Your shop / Edit Profile, has access in electronic form to the list of payment transactions in the My Account / Your Shop / Transactions tab.

    ARTICLE 5. PAYOUT RULES

    General rule for making withdrawals

    5.1. As part of the GO ELECTRIC ESCROW Service, the Seller receives a payment of funds to a verified bank account in the amount reduced by the costs incurred for GO ELECTRIC . Payments will be made according to the details mentioned in article 5.3.

    The moment of receiving the payment order by the Payment Operator

    5.2. GO ELECTRIC performs the withdrawal of funds registered as part of the User's billing tool no later than by the end of the next business day after the Payment Operator receives the payment order from the User. The moment of receiving the withdrawal order is:

    a. the moment when the order submitted by the User was received by the Payment Operator - in the case specified in article 5.5. a)

    b. the beginning of the day indicated by the User in the configuration form - in the case specified in Article 5.5. lit. b), 5.6 and 5.7. In the case specified in article 5.5. letter a) The User may not cancel the withdrawal order from the moment it is received by the Payment Operator. In the case specified in article 5.5. b), 5.6 and 5.7. The User may cancel the withdrawal order for funds recorded in the settlement tool no later than by the end of the business day preceding the withdrawal date indicated by the User.

    The scope of information necessary for the execution of the payment

    5.3. In order to make the payment referred to in articles 5.5-5.7, the Seller should complete the configuration form on the GOELECTRIC.PL website in the tab My Account / Your Shop / Edit Profile and Payment Details. When completing the configuration form, the User provides at least the following data: name and surname, address, e-mail address, telephone number, bank account number to which the funds collected as part of the settlement tool will be transferred. The User's data indicated above should be consistent with the data of the bank account holder related to the Seller's Identification. In the case of a Company account, the User must also enter the NIP number and additional information about the company in the "About the Store" field, ie at least the full name of the company. In the case of the Junior Account, it is possible to indicate in the above form the data of the legal guardian of the Account User. In the event of a change of the bank account, the User is obliged to inform GOELECTRIC.PL about it via the contact form at https://goelectric.pl/en/contact-us , and then undergo a new identification procedure.

    5.4. The payment indicated in Articles 5.5-5.7 shall be effective on the part of the User if all the required data has been provided correctly.

    Payout frequency

    5.5. The user as part of the use of the payment instrument referred to in Article 5.1. may order a withdrawal to a bank account maintained at a Polish bank:

    a. as a one-off payment (payment on demand),

    b. order recurring payouts and define their frequency (automatic payouts). The condition for the automatic withdrawal is to have at least PLN 20 of funds as part of the settlement tool.

    Custom Payouts

    5.6. Despite the principle contained in Art. 5.1. GO ELECTRIC , on a special request of the User, makes a withdrawal of funds recorded as part of the settlement tool by transfer to a bank account maintained by a bank based outside Poland, and such an order is accepted for execution on the first day of the month for amounts below PLN 100 and on the first and fourteenth day of the month for amounts above PLN 100 (if the 1st or 14th day of the month falls on Saturday or Sunday or a statutory holiday, the payment order is processed on the next business day). The User may separately order withdrawals to a bank account maintained by a bank with its registered office outside Poland at a time other than the one indicated above, after prior agreement with the Operator on the amount of the fee for such an order, which the User will be obliged to pay.

    5.7. Despite the principle contained in Art. 5.1. GO ELECTRIC , on a special request of the User, makes an automatic withdrawal of funds recorded on the payment account by postal order, provided that the value of these funds does not exceed PLN 800. Such orders are accepted and executed on the first day of the month. If the first day of the month falls on a Saturday or Sunday or a public holiday, the payment order is processed on the next business day. The User may separately order payments by postal order at a time other than the one specified above, after prior agreement with GO ELECTRIC amount of fees for such an order, which the User will be obliged to pay.

    5.8. The conditions for the payment by the User of funds recorded in the settlement tool to a foreign bank account are:

    a. the possibility of settling withdrawals in PLN by the User's bank; and

    b. the foreign account is kept by a bank established in one of the European Union countries or in an equivalent country within the meaning of the provisions on counteracting money laundering and terrorist financing.

    ARTICLE 6. PRIVACY AND CONFIDENTIALITY

    Rules for the protection of personal data of Users using the GO ELECTRIC ESCROW Service

    6.1. Users' personal data: name, surname, address, login, e-mail address, telephone number are transferred by Goelectric.pl to the Payment Operator in order to provide the GO ELECTRIC ESCROW Service, as well as in order to fulfill the obligations provided for in the applicable regulations by the Payment Operator. rights.

    6.2. The provision of personal data to the payment Operator concerns the data necessary to provide the GO ELECTRIC ESCROW Service and the performance of obligations related to the provision of the GO ELECTRIC ESCROW Service (i.e. data such as: name, surname, street and house number, zip code, city, e-mail address, telephone number, bank account number).

    6.3. With regard to Users' personal data provided by Goelectric.pl to the payment operator, the administrator of this personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and the repeal of Directive 95/46 / EC (general regulation on the protection of personal data), hereinafter referred to as "GDPR" - apart from Goelectric.pl there is also GO ELECTRIC .

    6.4. Users' personal data provided by Goelectric.pl to the payment operator are processed in accordance with the law, in particular in accordance with the provisions of the GDPR, the Act of July 18, 2002 on the provision of electronic services and the Act.

    6.5. GO ELECTRIC with due diligence selects and applies appropriate technical and organizational measures to protect the processed data, including programming security (including data encryption systems). GO ELECTRIC protects data against disclosure to unauthorized persons, as well as other cases of their disclosure or loss, and against destruction or unauthorized modification of the indicated data, as well as against their processing in violation of applicable law. GO ELECTRIC exercises constant control over the data processing process and limits access to data to the greatest possible extent, granting appropriate authorizations only when it is necessary for the proper provision of services.

    6.6. GO ELECTRIC provides Users whose personal data has been provided to him by Goelectric.pl, the implementation of the rights resulting from the GDPR. The User has the right to access data, as well as to rectify them, limit their processing, object to their processing, not to be subject to automated decision making, including profiling, and to transfer and delete data.

    6.7. Personal data of Users whose personal data has been provided by Goelectric.pl to the payment operator may be transferred to:

    a) entities authorized to receive such data under applicable law, including the competent judicial authorities, in particular as part of the payment Operator's obligations under applicable law and related to the provision of the GO ELECTRIC ESCROW Service by the Payment Operator;

    b) depending on the payment method selected by the User, the above-mentioned personal data may be transferred to: banks, payment institutions, loan institutions, payment card organizations, payment schemes) in order to provide the GO ELECTRIC ESCROW Service;

    c) also to entities supporting the activities of GO ELECTRIC ESCROW, i.e. IT infrastructure suppliers, suppliers of payment risk analysis tools;

    d) Sellers to inform them about the payment status under the GO ELECTRIC ESCROW Service,

    e) Goelectric.pl in order to prevent fraud on GO ELECTRIC .

    6.8. More information about the rules of processing the User's personal data by GO ELECTRIC ESCROW can be found in the GO ELECTRIC ESCROW Privacy Policy available here .

    ARTICLE 7. COMPLAINT PROCEDURE

    Rules for accepting and considering complaints

    7.1. The User may submit a complaint if the services provided for in these regulations have not been performed or are performed contrary to its provisions.

    7.2. A complaint may be submitted in the form of:

    a.in writing to the address of GO ELECTRIC ,

    b. electronically, using the contact form on the GO ELECTRIC website https://goelectric.pl/en/contact-us ,

    c. by telephone, at the following number: + 48 (48) 685 50 86 (connection payable according to the tariff of the operator whose services are used by the User), from Monday to Friday from 10:00 to 18:00.

    7.3. If the data or information provided in the complaint need to be supplemented, before considering the complaint, GO ELECTRIC asks the person submitting the complaint to supplement it in the indicated scope.

    7.4. GO ELECTRIC recognizes the complaint within 14 days from the date of its receipt. In the event that the consideration of the complaint requires cooperation by the Payment Operator with the bank that cooperated with it in handling the payment, the above-mentioned period may be extended by the time necessary to obtain the necessary information from the bank, but not longer than 60 days from the date of receipt of the complaint. . GO ELECTRIC informs the User about the extension of the deadline for considering the complaint, indicating the reason for the delay, the circumstances to be clarified and the deadline for providing a final answer.

    7.5. The answer to the complaint will be given by GO ELECTRIC ESCROW in writing or in electronic form, if the User has consented to it.

    7.6. The User is obliged to cooperate with the Payment Operator in order to clarify all issues related to complaints carried out by payment card issuers, in particular, he is obliged to provide all necessary information regarding the Transaction for which the claimed payment was made, and at each request of the Payment Operator, within 7 days from receiving such a request, provide the Payment Operator with copies of documents regarding the implementation of the Transaction, under which the User accepted the payment made with a payment card, including: a copy of the confirmation of sending the shipment ordered by the Buyer or confirmation of the completion of the ordered service. The User is obliged to keep these documents for a period of at least 24 months from the date of payment.

    7.7. The User may file a complaint against the action of the Payment Operator in breach of the law to the body supervising the Payment Operator.

    ARTICLE 8. PRINCIPLES OF IMPLEMENTING PAYMENTS IN THE PROCESS OF PURCHASING WITHOUT REGISTRATION

    Payments for purchases in the "without registration" mode

    8.1. The provisions of this article set out special rules for handling payments by GO ELECTRIC ESCROW for Users who make Transactions without creating an Account, in accordance with the provisions of Art. 2.7. Of the GO ELECTRIC Regulations. In the remaining scope, not regulated in this article, the remaining provisions of the regulations of the GO ELECTRIC ESCROW Service shall apply.

    8.2. Payment within the meaning of this article means the payment made by the Buyer to the Seller through GO ELECTRIC ESCROW in order to fulfill the pecuniary obligation arising from the Transaction between the Buyer and the Seller, constituting a single payment transaction within the meaning of the Act.

    8.3. As part of the Service for Buyers, referred to in art. 8.1. GO ELECTRIC ESCROW does not maintain a payment account or a billing tool.

    8.4. In order to use the GO ELECTRIC ESCROW Service, the Buyer should provide the following data: name, surname, street and house number, zip code, city, e-mail address, telephone number. In justified cases, GO ELECTRIC ESCROW is entitled to request from the Buyer other data necessary to assess the Payment risk, with the exception of the data referred to in art. 9 GDPR.

    8.5. GO ELECTRIC ESCROW provides the GO ELECTRIC ESCROW Service on the basis of the payment order received from the Buyer, the submission of which is possible after accepting the GO ELECTRIC Regulations, including these Regulations of the GO ELECTRIC ESCROW Service and providing the data specified in Article 8.4 above

    8.6. The moment of receipt of the payment order by GO ELECTRIC ESCROW is the date on which the GO ELECTRIC ESCROW bank account was credited with the Payment amount. If GO ELECTRIC ESCROW received a payment order on a day which is not a business day for GO ELECTRIC ESCROW, it is assumed that the payment order was received on the first business day following that day.

    8.7. The Buyer is informed about the Payment made in the form of an electronic message enabling the recording of the data contained therein.

    ARTICLE 9. CHANGES TO GO ELECTRIC ESCROW REGULATIONS

    Rules for changing the regulations of the GO ELECTRIC ESCROW Service

    9.1. GO ELECTRIC will inform the User about any changes to the provisions of the contract contained in these regulations no later than 2 months before the proposed date of their entry into force. The information will be provided on the GO ELECTRIC website in a way that allows its recording and reproduction of the stored data in an unchanged form or in a written (paper) form - at the request submitted by the User in the manner specified in the article

    9.2. If, before the specified date of entry into force of the amendments to the agreement, the User does not object to such amendments, the User shall be deemed to have consented to them. In the event that the User objects in writing, but does not terminate the contract in the manner specified in Article 9.3. the agreement shall expire on the day preceding the effective date of the proposed amendments.

    9.3. The user has the right to terminate the contract before the date of the proposed entry into force of the changes by submitting a written notice of termination to the address of GO ELECTRIC . In this case, the contract is terminated with immediate effect, however, the implementation of the commenced GO ELECTRIC ESCROW Services for Users will be completed on the terms set out in these Regulations of the GO ELECTRIC ESCROW Service.

    ARTICLE 10. OTHER PROVISIONS

    Resignation from the GO ELECTRIC ESCROW Service

    10.1. Within 14 days from the conclusion of the contract referred to in Art. 1.3. and 1.4, the Buyer may withdraw from it without giving reasons, by submitting a declaration in electronic form to the address sprzedaz@goelectric.pl or in writing to the address GO ELECTRIC ul. Władysława Beliny Prażmowskiego 2, UP1 P.O. 115, 26-600 Radom. In this case, the Buyer can still make purchases, but will not be covered by the Buyer Protection Scheme. The User acknowledges that the GO ELECTRIC ESCROW Service will be performed immediately after the conclusion of the contract for the provision of this Service.

    10.2. The Buyer is entitled to terminate the contract specified in Articles 1.3 and 1.4 at any time by submitting an appropriate declaration in electronic form to the address sprzedaz@goelectric.pl or in writing to the address GO ELECTRIC ul. Władysława Beliny Prażmowskiego 2, UP1 P.O. 115, 26-600 Radom.

    ROOM GO ELECTRIC

    10.3. All Buyers who made purchases at GO ELECTRIC , using the GO ELECTRIC ESCROW Service, are covered by the GO ELECTRIC Buyer Protection Program, the terms of which are governed by the " GO ELECTRIC POK" regulations, found in Annex 9 to the Regulations.

    Reference to the GO ELECTRIC

    10.4. In matters not covered by these regulations, as well as in the definition of terms used in these regulations, written with a capital letter, the provisions of the GO ELECTRIC Regulations shall apply, unless these regulations provide otherwise.

    Governing Law

    10.5. The law applicable to the contract between the User and GO ELECTRIC , and the contract between the User and the Payment Operator, the subject of which are services provided by the Payment Operator, as part of the GO ELECTRIC ESCROW Service under the conditions set out in these regulations, is Polish law.

    Appendix No. 9 Buyer Protection Program (POK) - regulations

    Part I. General Principles

    1. Thanks to GO ELECTRIC ESCROW payments ( Annex 7A ), Goelectric.pl can guarantee real protection of purchases under the Buyer Protection Program and, unlike other websites, guarantees the Buyer full compensation for purchases on Goelectric.pl websites and regardless of the amount, if:
      a) paid for the Goods but did not receive it;
      b) received Goods inconsistent with the concluded contract, with a value significantly lower than the Goods described in the offer due to the fault of the Seller.
    2. In the cases specified in point 1 (a) and (b) above, the compensation covers the value of the damage suffered by the Buyer, but not higher than the actual value of the purchased Goods, up to the price specified in the Transaction parameters. In the event of the circumstances referred to in point 1, point a, the Buyer receives 100% compensation. In the event of the circumstances referred to in point 1 (b), depending on the situation (see point 5) and the will of the Buyer, compensation may be total or partial, for example, when the Buyer agrees to the Seller's offer regarding the purchase made, but after reduced price due to product defects found by the Buyer.
    3. In the event of the circumstances referred to in point 1 point a and b above, GO ELECTRIC will grant compensation only if the payment for the Goods was made using the payment services options provided in GO ELECTRIC or directly to the GO ELECTRIC bank account.
    4. The Buyer Protection Program also allows the Buyer to compensate for shipping costs, including the value of the damage suffered by the Buyer. The amount of compensation for the shipment will be limited to PLN 100 if payments other than "Pay by Bank Transfer" are selected when shopping at GOELECTRIC.PL.
    5. In situations of conflicting relations between the Buyer and the Seller, the value of the compensation will be determined by the Customer Service Center each time by GO ELECTRIC after considering the evidence provided by both the Buyer and the Seller.

    Part II. Exclusions from the Buyer Protection Program

    The Buyer Protection Program does not cover situations where:

    1. The contract was concluded and implemented on terms other than those specified in the GO ELECTRIC Regulations, in particular outside the GO ELECTRIC ESCROW service, which is automatically and free of charge received by all https://goelectric.pl/en/ users until they resign from it in writing.
    2. The buyer violated the rules of GO ELECTRIC or did not pay all amounts due to Goelectric.pl.
    3. The Buyer acted with the intention of purchasing the defective or not as described Goods.
    4. The buyer did not provide correct contact details.
    5. The Buyer received other measures to compensate for the loss related to the purchase of the Goods that were the subject of the notification.
    6. The offer was not in accordance with the GO ELECTRIC Regulations, in particular, the Goods were not admitted to trading on GO ELECTRIC due to the list of prohibited and conditionally admitted goods, indicated in the GO ELECTRIC Regulations.
    7. The Buyer has not exhausted all means of resolving the conflict with the Seller.

    Part III. Application for the Buyer Protection Program

    1. In order to receive compensation from the Buyer Protection Program, the Buyer should complete and send to Goelectric.pl in electronic form the form available on the GO ELECTRIC website ( https://goelectric.pl/en/contact-us ) along with the attachments referred to in point 1 Part IV below, providing the necessary data and describing the course of the Transaction and the performance of the contract (hereinafter: the Form).
    2. The Buyer is obliged to present GO ELECTRIC confirmation of submitting the notification of a crime to its detriment by the Seller to law enforcement authorities (hereinafter: Confirmation of Notification), unless Goelectric.pl decides to resign from this requirement, in cases where the decision to grant compensation to the Buyer does not doubts (in particular when the Goods have not been delivered to the Buyer). At the same time, if it turns out to be necessary to make a decision on granting compensation, Goelectric.pl may request that a decision to initiate an investigation / investigation be attached to the Form and that the Buyer provides the reference number for the initiation of the procedure (the relevant RSD or DS number).
    3. The form should be sent to Goelectric.pl not earlier than 14 days from the delivery of the goods, but not later than the duration of the GO ELECTRIC ESCROW service (see Annex 7A , point 1.4). In justified cases, the period indicated above may be shortened or extended. The Buyer will be informed by Goelectric.pl about the shortening or extension of the deadline via e-mail.

    Part IV. Consideration of the application for compensation

    1. Goelectric.pl decides to accept the application within 30 working days of receiving a correctly completed Form with the following attachments:
      a) the original or a copy of the proof of payment of the amount for the Goods to the Seller's account. Proof of payment of the amount for the Goods to the Seller's account is not required in the event that the Buyer made a payment for the Goods via the payment services provided at GO ELECTRIC ,
      b) a photocopy of each page of the ID card with the number and series, PESEL number (in the case of the Junior Account, a photocopy of each page of the school ID including the following data: number and series of the document, name and surname, address and expiry date),
      c) a photocopy of the Confirmation of Notification to law enforcement authorities.
    2. The data provided in the Form should be true and correspond to the factual state at the time of submitting the Form. In order to verify information and data, Goelectric.pl, while considering the Form, may contact the Buyer or the Seller and request additional documents confirming the course of events. If there are doubts as to the legitimacy of the Buyer's claim or inaccuracies in the description of the Transaction or inaccuracies related to the execution of the Transaction, Goelectric.pl has the right to refuse to grant or pay compensation. In justified cases, when the conditions set out in point 1 point b Part I of this Annex are met, Goelectric.pl may make the payment of compensation conditional on sending the Goods to the registered office of Goelectric.pl.
    3. The Buyer is obliged to immediately inform Goelectric.pl if any events occur in the period after sending the Form, causing his claim against the Seller to change. In particular, if he receives any compensation or damages, or if the Seller remedies in part or in whole the damage suffered by the Buyer or its consequences.
    4. If, during the consideration of the Form, the situation is clarified in favor of the Buyer by the receipt of the Goods or a refund, no compensation will be granted.
    5. If the Buyer has received an undue service or the Seller has repaired the damage, the Buyer is obliged to immediately, not later than within 7 days, return the compensation received from Goelectric.pl to the account provided in Appendix 7C .
