Section 1. DEFINITIONS

The terms used in this document mean:

Article 2. TERMS OF PARTICIPATION IN GO ELECTRIC

2.1.

Users may be natural persons who are 18 years of age and have full legal capacity, legal persons and organizational units without legal personality, but which may acquire rights and incur obligations on their own behalf. Users may be persons who are 13 years of age but under 18 years of age to the extent that they can acquire rights and incur obligations, in accordance with the provisions of generally applicable law and subject to the rules provided for them (Junior Account), the content of which is attached as Appendix No. 6 to the Regulations.

2.2.

Natural persons who do not conduct GO ELECTRIC choose one of the following Registration types by completing the appropriate form for each of them, where:

a. Full registration, subject to the provisions of Art. 2.6. below, allows you to purchase and sell Goods (Normal Account);

b. Simplified registration allows only the purchase of Goods.

2.3.

Natural persons conducting business activity, legal persons or organizational units referred to in art. 2.1, register using the appropriate registration form by providing the data specified therein. Then, these entities send to Goelectric.pl a copy of the documents confirming the data on the conducted activity. The obligation to send copies of these documents does not apply to Users whose enterprise is based in Poland and who, after the Registration, have fully activated the Account by making a payment by traditional transfer or other electronic transfer from the account belonging to the entity making the Registration. On behalf of the entities mentioned in the first sentence of this article, the activities referred to above may be performed by a person authorized to do so.

2.4.

The sale of Goods under the Company Account should be related only to the business activity conducted by the User on GO ELECTRIC . At the same time, sales not related to the User's activity referred to in the preceding sentence should be made under the Normal Account.

2.5.

After completing the registration form, a message will be sent to the e-mail address provided in it, indicating how to confirm the Registration, and other information required by law. Upon confirmation of the Registration, an agreement is concluded between the registered entity and Goelectric.pl, the subject of which are the services provided by Goelectric.pl as part of GO ELECTRIC , under the conditions specified in the Regulations.

2.6.

The User, in order to gain access to all services provided by GO ELECTRIC , must activate the Account by selecting one of the following methods provided by GO ELECTRIC :

a. Payment for the purchased item using the payment service specified in Annex 7B to the Regulations - in the event that the payment for the purchased Goods will be made in the form of an electronic transfer from an account kept in one of the banks providing the so-called "Quick payments" under GO ELECTRIC ,

b. Payment by traditional transfer or other electronic transfer - in the amount of PLN 1.01 to the bank account indicated in Annex 7C to the Regulations. The payment will be fully refunded to the User to the bank account from which it was made.

2.7.

The entities referred to in Art. 2.1, may purchase Goods without prior Registration and having an Account. In this case, after selecting the Goods (adding to the basket), it is necessary to provide the relevant data required in the form, necessary to finalize the contract concluded with the Seller in this way. Upon the purchase of the Goods, the entity referred to in the previous sentences concludes a contract the subject of which are services provided by Goelectric.pl as part of GO ELECTRIC , under the conditions specified in the Regulations.

2.8.

The User should update the data in the settings on an ongoing basis after logging into the Account. After Registration, the User is forbidden to delete the data contained in the Account settings, as well as to provide incomplete or untrue data.

2.9.

The User gains access to the Account in GO ELECTRIC after entering the login or e-mail address and password (Login). Logging in to GO ELECTRIC via the automated solutions service and through other websites cooperating with Goelectric.pl, including social networking sites, has the same effects as logging directly on the GO ELECTRIC website.

The User gains access to the Account in GO ELECTRIC after entering the login or address. The use of automated solutions, in particular the software that triggers the login, is at the risk of the User using such software.

2.10.

The User may register more than one Account, provided that each of them is assigned a different e-mail address. The User may not use the Accounts to perform activities constituting a breach of the provisions of the Regulations. In particular, it is unacceptable:

a.participating in a given Bidding using more than one Account,

b. bidding or concluding a contract for the sale of Goods as part of own Offers, close or cohabiting with the User or other entities with whom the Buyer has reasonable doubts that the parties act in concert to influence the result of the Transaction, in a manner against the law or morality,

c. making another Registration in order to avoid payment of amounts due to Goelectric.pl, for services provided under GO ELECTRIC .

2.11.

The User may not use the Accounts of other Users and make the Account available to other persons, except in the following cases:

a.provision of the Company Account to persons duly authorized by the User to act on his behalf,

b. making the Regular Account available to the User's spouse by entering the data of the User's spouse in the appropriate form, provided that the Normal Account User has used the payment service at least once, referred to in Appendix 7B to the Regulations, or at least once paid for services provided under GO ELECTRIC . The spouses using the Account are jointly and severally liable for actions taken under this Account.

2.12.

Accounts are non-transferable, provided that, with the consent of Goelectric.pl:

a. The Company Account may be disposed of in the event that the User transfers to another entrepreneur the rights and obligations related to running the enterprise or part of it, in the form provided for by law,

b. A Normal Account may be transferred by the User to his spouse.

2.13.

In a situation where the Account or the User's activity as part of GO ELECTRIC requires additional verification of the data referred to in art. 2.1. or 2.3, or if Goelectric.pl has reasonable concerns about the security of the Account or Transaction, in particular regarding the unauthorized takeover of the Account by another person, Goelectric.pl may:

a.make the use of GO ELECTRIC on the User's confirmation with relevant documents of his credibility, including identity,

b. temporarily limit access to individual services provided as part of GO ELECTRIC ,

c. suspend the User's Account for a definite or indefinite period.

After the abovementioned circumstances cease to exist, Goelectric.pl will remove the said restrictions applied to the User.

2.14.

Within 14 days from the conclusion of the contract referred to in Art. 2.5, the User may withdraw from it without giving reasons. The rules for withdrawing from the contract, including the model withdrawal form that the User may use, are set out in the instruction, constituting Appendix No. 8 to the Regulations. The right to withdraw from the contract is not entitled to the User who has placed the Offer, participated in the Auction, used the Buy Now option or has any receivables towards Goelectric.pl, for services provided under GO ELECTRIC .


II. TRANSACTIONS

Article 3. OFFERS

3.1.

As part of GO ELECTRIC , the Seller, by specifying the terms of the Offer, may provide the Buyers with the following methods of concluding a sales contract:

a. Only with the Buy It Now option, where the Seller offers to sell the Goods at a predetermined price. This offer may include one or more pieces of the Goods,

b. Auction, under which the Seller, by listing the Goods, invites Bidders to submit bids in order to conclude a contract. The auction may include only one piece of the Goods. As part of the Auction, the Seller may additionally specify the Buy It Now option, and if the Seller sets the minimum price under the terms of Art. 3.2., The Buyer may use the Buy It Now option only until the Bidder submits an offer equal to this price. If the Seller has not set the minimum price, the Buyer may use the Buy It Now option until the Bidder submits the first bid.

3.2.

In the Bidding, the Seller may set a reserve price, i.e. the lowest price for which he agrees to sell the Good. Proposing a lower price by the Bidders than the minimum price will not result in the conclusion of a sales contract. The amount of the minimum price is not public for Users until the Bidder offers a price equal to or higher than the minimum price.

3.3.

The purpose of Offers without a price in the categories of Services and Rental is not to conclude a contract between Users. These offers are only advertisements, and their presentation is regulated by the price list for advertisements (see Appendix 4).

3.4.

Offers of Goelectric.pl or an entity with which Goelectric.pl cooperates on the basis of a separate agreement, may take the form of a Special Offer, while the Special Offer may also include its own sale of Goods conducted by Goelectric.pl.

3.5.

In the special offer referred to in Art. 3.4. above, the Seller may limit access to the Offer by allowing only the Users or Users who have been invited by him or verified to meet the criteria specified by the Seller or the provisions of applicable law to participate in it. Due to the special nature of this Offer, the rights and obligations of the Sellers or Buyers contained in its content may be shaped differently than in the Regulations.


Article 4. PROHIBITED GOODS

4.1.

The Sellers undertake not to display on the Transaction the Goods whose turnover violates the applicable law or the rights of third parties (in particular copyrights and other intellectual property rights), as well as the display of which may be considered contrary to good practice.

4.2.

Notwithstanding the provisions of Art. 4.1. it is forbidden to display items listed as prohibited in Annex 1 to the Regulations.

4.3.

Items referred to in Art. 4.1. and 4.2. they cannot be offered together with the Goods as a free add-on (free of charge).

4.4.

Displaying certain types of Goods requires the fulfillment of additional conditions, specified in Annex 1 to the Regulations.


Article 5. BEGINNING OF THE TRANSACTION

5.1.

The Seller draws up an Offer by completing GO ELECTRIC , thus specifying the overall terms of the Transaction. The information contained in the content of the Offer may only concern its subject. At the moment of introducing information or data to the content of the Offer, Goelectric.pl acquires the right to use them, in particular to use them in any way, at any time, at its sole discretion. By placing information or data in the content of the Offer, the Seller declares that he is entitled to introduce them to the content of the Offer, and using them as part of GO ELECTRIC and by Goelectric.pl - in particular in the manner specified in the preceding sentence - does not infringe the rights of third parties. The seller is liable for the truthfulness of the declaration referred to in the preceding sentence.

5.2.

The content of the Offer should be reliable and complete and may not mislead other Users, in particular as to the properties of the Good, such as: its condition, quality, origin, brand or manufacturer. The content of the Offer should comply with the law, in particular contain information resulting from the applicable provisions on the protection of consumer rights. The User bears full responsibility for the content placed by him in the Offer, including he is responsible for any errors or inaccuracies thereof.

5.3.

Regardless of the provisions set out in Art. 4.1, the Seller declares that he is entitled and has the ability to conclude and perform the contract with the Buyer.

5.4.

When performing the activities referred to in Art. 5.1, the Seller orders Goelectric.pl to publish the Offer on the date indicated by him. If the date has not been specified, publication will take place immediately. The number of simultaneously published User Offers may not exceed 100,000 without the consent of Goelectric.pl, while it is also forbidden to order Goelectric.pl to publish Offers for the same Goods, in a number that may threaten the principles of fair competition within GO ELECTRIC

5.5.

From the moment of publishing the Offer, the Seller is bound by its content. The Seller may amend the content of the Offer until the Bidder submits the first offer. In the case of an Offer with the Buy It Now option, the Seller cannot effectively change its content for Buyers with whom it has concluded a sales contract under the Offer. It is forbidden for the Seller to make changes to the content of the Offer that change the offered Good or its properties. At the time of publishing the Offer, the Seller agrees to use its description (content and photos) in whole or in part for promotional and marketing purposes both in GO ELECTRIC and outside it, as part of Goelectric.pl's cooperation with third parties.

5.6.

Detailed rules for the preparation of the Offer, including its content, photos and the use of additional options for its presentation and promotion in GO ELECTRIC are set out in Annex 2 to the Regulations.

5.7.

As part of GO ELECTRIC Sellers may enable Buyers to pay for the goods using the payment service provided in GO ELECTRIC and "cash on delivery", or by direct payment at the place of receipt of the Goods. Handling the payment by the Buyer for the Goods as part of the payment service provided in GO ELECTRIC , takes place on the terms set out in Annex 7A and Annex 7B to the Regulations.

5.8.

The offer should be placed in the category corresponding to the specificity of the Good.


Article 6. COURSE OF TRANSACTIONS

6.1.

By accepting the conditions presented by the Seller in the content of the Offer, the User, in order to purchase the Goods, takes part in the Auction or selects the Buy It Now option, subject to Art. 3.3 of the Regulations. By performing the above activities, the User completes the appropriate form on the Offers page and confirms his choice.

6.2.

Upon participation in the Auction, personal data regarding the name of the Bidder's Account (login) are transferred to the Seller.

6.3.

During the publication of the Offer, Users, using the appropriate form, may ask the Seller questions about this Offer GO ELECTRIC The content of the question is automatically sent to the e-mail address of the Seller, to whom the e-mail address of the User asking the question is also disclosed.

6.4.

By entering the Auction, the Bidder declares the maximum price of the Good, which he undertakes to pay in the event of winning. The Bidder may change the maximum price during the Bidding, but may not indicate an amount equal to or lower than the current price specified in the Bidding. The bids of other Bidders, depending on the current price of the Good, are outbid by the appropriate increment amount, in accordance with the table below, unless the seller sets otherwise for a given auction:

6.5.

Bids submitted by Bidders shall be binding upon the Bidding participants, unless the Seller rejects them. The rejection of the Bidder's offer may take place only before the end of the Auction:

a. at the Bidder's request or

b. when the Seller has reasonable doubts as to the credibility of the Bidder,

c. if the theft or destruction of the Good took place during the Auction,

d. in connection with the end of the Auction, in the cases specified in Article 6.8.

6.6.

The proposal to conclude a contract with the Seller, submitted by the Bidder whose Account is suspended before the closing of the Auction, ceases to be binding. Information about the suspension of the Bidder's Account is displayed on the Bidding page.

6.7.

The Offer ends with the lapse of the time specified in its terms by the Seller or when all items of the Goods in the Offers with the Buy It Now option are sold. The Offer may be terminated earlier:

a. on the basis of the Seller's decision referred to in art. 6.8.

b. on the basis of the decision of Goelectric.pl, in the situations described in art. 8.2 point b.

6.8.

The Seller may terminate the Offer at any time. In case of:

a. Offers with the Buy It Now option - the sales contracts concluded so far as part of such an Offer are binding,

b. Auction - the winners are determined according to the state at the time of its completion, in accordance with Art. 7.2.

6.9.

The price for the Goods should be determined in accordance with generally applicable laws. The Seller, in addition to the price for the Goods, may additionally charge the Buyer only with the actual delivery costs indicated in the Offer.

6.10.

The procedure to be followed in the case of planned technical breaks and technical failures, in particular their impact on the published Offers, is set out in Annex 3 to the Regulations.


Article 7. CONCLUSION OF AN OFFER AGREEMENT

7.1.

GO ELECTRIC is not a party to the contracts for the sale of Goods concluded between Users and does not guarantee that the Seller and the Buyer are entitled to conclude and perform the contract.

7.2.

The contract is concluded with the winner of the Auction. The winner of the Bidding is the User who, at the time of its completion, offered the highest price for the Good and his bid was at least equal to the minimum price, if the price was determined by the Seller (check-in). If several Bidders submitted bids with the same highest price - the winner is the Bidder who first entered the Auction by indicating the highest price.

7.3.

The Buyer using the Buy Now option concludes a contract with the Seller, confirming the purchase with the "buy and pay" button, subject to the content of art. 3.3.

7.4.

Confirmation of the conclusion of the contract between the Buyer and the Seller is sent automatically via e-mail (or optionally via other means of electronic communication) and is for information purposes only. In the message referred to in the preceding sentence, the parties to the contract receive the data currently appearing in their Account settings, i.e. name and surname, e-mail address, telephone number, address. If the Buyer chooses the form of delivery of the Goods, which involves giving the shipment a registration number and if this number has been made available in the "Purchased" tab, visible after logging in to the Account, the Buyer receives an additional e-mail message in which the following is indicated: (company) carrier, shipment registration number and tracking link.

7.5.

The seller may, under the confirmation referred to in art. 7.4, provide additional information related to the conclusion of the contract ("Message to the Buyer"). In the content of the Message for the Buyer, the Seller may not violate applicable law or the Regulations. Detailed rules regarding the content of Messages for the Buyer are set out in Annex 2 to the Regulations.

7.6.

The Buyer, in connection with the concluded contract, should pay for the Goods within 7 days, unless the parties to the contract have agreed otherwise.


Article 8. ROLE OF GO ELECTRIC

8.1.

Unlike many websites, Goelectric.pl can guarantee real protection to the buyer thanks to escrow payments, which consist in the fact that all funds for purchases made by the buyer first go to GO ELECTRIC , where they are kept until the buyer accepts the product. Both the consumer and the company have 14 days to do so from receiving the order. If during this time the buyer does not raise any objections to the purchased goods, the funds are transferred to the seller's account after deducting fees and commissions in accordance with Annex 4 to the Regulations. Detailed rules for the protection of buyers and the resolution of problems with defective or undelivered goods are set out in Annex 9 to the Regulations.

8.2.

Goelectric.pl provides protection for buyers, but is not responsible for the behavior of Users under GO ELECTRIC or for improper performance or non-performance of contracts concluded as part of the Transaction, as well as for the consequences of actions taken by Users and third parties, and constituting a breach of the provisions of the Regulations. Goelectric.pl, in particular, is not responsible for the quality, safety or legality of the Goods sold under the Offer, the Sellers 'ability to sell, the Buyers' solvency and the truthfulness and reliability of the information provided by Users. Goelectric.pl, on the terms set out in Annex 9, allows compensation to be granted to Buyers who have suffered damage as a result of the Seller's dishonest actions. At the same time, for the performance of contracts concluded as part of GO ELECTRIC , in connection with the conduct of its own sale of Goods, Goelectric.pl bears responsibility specified in accordance with the provisions of generally applicable law and the content of Goelectric.pl offers.

8.3.

In the event that the Offer violates the provisions of the Regulations or applicable law, Goelectric.pl may:

GO ELECTRIC category indicated by the Seller, in which the Offer is published,

b.end prematurely or remove the Offer with the Buy It Now option - however, the contracts concluded so far between the Users remain valid,

c. delete the Auction, as a result of which it is no longer available in GO ELECTRIC , and any previous activities of the Bidders within its framework have no effect.

8.4.

Goelectric.pl may verify compliance with the Regulations by Users. Verification may take place, in particular, by checking whether the Users comply with the relevant provisions of the Regulations. Verification takes place in particular by establishing contact with the User and recording its course.

8.5.

If the User's actions violate the provisions of the Regulations, Goelectric.pl, depending on the type, scale and circumstances of the violation, may:

a.Remind the User via e-mail,

b.end the User a warning via e-mail,

c. temporarily limit the User's access to individual services provided as part of GO ELECTRIC , in particular limit the functionality of the User Account for a definite or indefinite period,

d. make the use of GO ELECTRIC dependent on the User's confirmation of the fulfillment of the contract concluded as a result of the Transaction,

e. suspend one, several or all of the User's Accounts for a specified or indefinite period. The suspension of the Account may occur, in particular, as a result of repeated violation of the rules described in Appendices 1 and 2 to the Regulations.

8.6.

Regardless of the application by Goelectric.pl of the provisions of Art. 8.3, 8.4 or 8.5 of the Regulations, the User is fully responsible for his actions and omissions related to the use of GO ELECTRIC , in particular he may be liable for damages towards Goelectric.pl or other Users.

8.7.

If the Account is suspended, the User will lose access to it, unable to use any services provided by Goelectric.pl as part of this account in GO ELECTRIC . Offers issued under a suspended Account will be deleted. The result of the Auctions in which the Bidder whose Account was suspended participated in shall be determined in accordance with Art. 6.8.

8.8.

The User whose Account has been suspended or on whom functional restrictions have been imposed, referred to in art. 2.13 and 8.5, he cannot both register a new Account and use another Account without the prior consent of Goelectric.pl.


Section 9. FEES AND CHARGES

9.1.

Services provided by Goelectric.pl as part of GO ELECTRIC are payable. The Seller is charged with all fees and commissions. These receivables are accrued on an ongoing basis and presented for payment for subsequent settlement periods. The calendar month is the billing period.

9.2.

Fees and commissions for services provided by Goelectric.pl as part of GO ELECTRIC are paid by the User to the GO ELECTRIC bank account indicated in Annex 7C to these regulations - to go, click here .

9.3.

User actions whose purpose or effect is to avoid payment in connection with fees or commissions charged by Goelectric.pl are not allowed.

9.4.

For services provided under GO ELECTRIC , Goelectric.pl issues invoices in accordance with the data contained in the Account settings, while the User of the Normal Account - at his request.

9.5.

The amount of fees and commissions for individual services, the rules for their collection, method of calculation, as well as the rules for granting transaction discounts to receivables for the provision of services by Goelectric.pl in a given month and the method of their calculation, as well as the rules for issuing and sending invoices are regulated in Annex 4 to the Regulations.


Article 10. OTHER DUTIES OF USERS

10.1.

All actions taken by the User as part of GO ELECTRIC should comply with good practice and applicable law, including those relating to the protection of consumer rights. The User may not take actions that adversely affect the safe operation of GO ELECTRIC or harm the Users.

10.2.

The User is obliged to explain the correctness of the performance of the contract concluded between the Buyer and the Seller. The Seller is obliged to answer and provide comprehensive explanations in the Discussion within 24 hours of the Buyer's filing of charges, with the proviso that this time does not run on Saturdays, Sundays and other public holidays.

10.3.

The number of Discussions ended as unsolved at the Seller, who concluded more than 1000 contracts in the last 60 days, should not exceed 0.2% of the number of all contracts concluded at that time. If in the last 60 days the Seller has concluded fewer than 1000 contracts, the number of Discussions completed as unresolved in this period may not exceed two.

10.4.

Users should archive information about contracts concluded under GO ELECTRIC on their own.

10.5.

All materials, including graphic elements, layout and composition of these elements (the so-called layout), trademarks and other information, available on the GO ELECTRIC websites are subject to the rights of Goelectric.pl or the Users. The indicated elements are subject to proprietary copyrights, industrial property rights, including rights from trademark registration and database rights, and as such enjoy statutory legal protection.

10.6.

Downloading or using in any scope the materials available on GO ELECTRIC requires the consent of Goelectric.pl each time and may not violate the provisions of the Regulations and generally applicable law, and may not infringe the interests of Goelectric.pl and the Users. It is forbidden to:

a. the use by third parties of markings to which Goelectric.pl is entitled, including characteristic graphic elements, in particular: logos, photos, descriptions or other types of markings,

b. aggregation and processing of data and other information available at GO ELECTRIC for the purpose of their further sharing on other websites as well as outside the Internet.


Article 11. EVALUATION SYSTEM

11.1.

As part of GO ELECTRIC Users are provided with an evaluation system in both descriptive and graphic form (i.e. graphical evaluation of sales), which is used to exchange subjective opinions about the course of the Transaction and the performance of the contract. If an agreement was concluded between the Users, the Buyer, within no more than 90 days from the date of the conclusion of the agreement, may issue a review to the Seller. It is not possible to issue an assessment in a situation where the Buyer has made a purchase on the terms described in art. 2.7., And also when the Account has not been fully activated or its Account is suspended.

11.2.

Descriptive evaluation can be either recommending or not recommending the purchase. Graphical evaluation of sales allows the Buyer to evaluate the course of the contract by the Seller on a scale of 1 to 5.

11.3.

The rating is always assigned to a given Account and a specific Transaction. The user is responsible for the content included in the ratings.

11.4.

The content of the assessments is public information, available to all visitors of GO ELECTRIC .

11.5.

The assessments should be consistent with the actual course of the Transaction and may not include:

a vulgarisms, obscene, pornographic or inciting to spread hatred, racism, xenophobia,

b. contact details or logins of Users,

c. website addresses or advertising content.

11.6.

The User is not allowed to participate in the Transaction solely for the purpose of rating (e.g. to artificially inflate or lower the Seller's credibility).

11.7.

Goelectric.pl does not interfere with the content of the ratings and answers, however, it reserves the right to edit, delete or block the possibility of issuing them in justified cases, when:

a. violate the provisions of the Regulations, in particular Article 11.5 or 11.6,

b. have been mistakenly issued to the wrong User or to the wrong Transaction, if their content clearly indicates an error,

c. the content of the assessment clearly indicates a mistake as to its type,

d. the content of the assessment contains characters that make it illegible.

11.8.

The parties to the contract have the option of agreeing to remove the issued "I do not recommend" ratings by using the appropriate form available at GO ELECTRIC or contact us by email: pomoc@goelectric.pl. Ratings will be removed when the following cumulative conditions are met:

a.A request for removal will be submitted by the Seller within 21 days of receiving the assessment,

b. The Buyer will respond positively to the request no later than within 14 days of its receipt.

11.9.

After removing the assessment in the manner described in Art. 11.7. The Buyer may re-evaluate the course of the Transaction, provided that 90 days have not elapsed from the date of concluding the contract under a given Offer.

11.10.

Users have the option of posting GO ELECTRIC , including its advantages and disadvantages. They are presented as part of the Offers, in the "Opinions" tab.

11.11

Opinions published in the "Opinions" tab are subjective opinions of the Users. Users are responsible for the content of their statements as part of the opinions in question.

11.12.

The User's opinion may not violate applicable law, including the rights of third parties - in particular, it may not be defamatory, infringe personal rights or constitute an act of unfair competition. At the same time, regarding the rules for placing opinions by Users, the provisions of Art. 11.5 and 11.6 shall apply accordingly.

11.13.

Goelectric.pl reserves the right to edit or delete an opinion in justified cases, when the opinion:

a.is another opinion referring to the same Good,

b. relates to a Product other than the one under review,

c. violates the principles set out in Art. 11.12,

d. violates applicable law, good manners or violates religious feelings,

e. infringes patent rights, copyrights, trade secrets or other intellectual property rights, or the right to protect personal data,

f. is only a summary of a film, book or CD, etc.,

g. is fully or partially copied from other Users, the producer of the reviewed Good or from other available sources,

h. its content contains characters that make it illegible. i.

11.14.

By posting an opinion, the User agrees to its free use by Goelectric.pl or other entities cooperating with Goelectric.pl on the basis of separate agreements, as well as its modification in the above-mentioned scope.


III. FINAL PROVISIONS

Section 12. OTHER SERVICES

12.1.

Goelectric.pl may provide Users with other services, supporting the main activity of Goelectric.pl or facilitating the use of Goelectric.pl services, including financing, securing or advertising Transactions, on the terms set out in the regulations of such services, as well as mediating Goelectric.pl in concluding contracts for third party services.

12.2.

Goelectric.pl may provide Users with information about services and offers of services from external suppliers (e.g. offering financial services, including insurance), facilitating Users to use Goelectric.pl services, including financing, securing or advertising Transactions.


Section 13. PRIVACY AND CONFIDENTIALITY

13.1.

Personal data provided by Users in designated places, Goelectric.pl processes in accordance with applicable law and in accordance with the privacy policy contained in Annex 5 to the Regulations.

13.2.

Users are disclosed personal data of other Users only in the cases provided for in the Regulations for the purposes of carrying out Transactions and in other cases, with the prior consent of the data subject.

13.3.

The User is obliged not to disclose to third parties information about other Users that he received from Goelectric.pl in connection with the use of GO ELECTRIC , unless he obtained prior consent from the User to whom the data relates. In particular, it is forbidden to use the information in question for commercial purposes, including, in particular, promoting in any form the User's activity outside GO ELECTRIC .

13.4.

It is forbidden to use the information referred to in Art. 13.3, for commercial purposes consisting in promoting in any form the User's activity outside GO ELECTRIC . In particular, it is forbidden to:

a) submitting a proposal to buy or sell the Goods outside GO ELECTRIC (this does not apply to the Offers referred to in Article 3.3);

b) attaching to the shipped Goods or delivering in any other form content containing information about commercial activities conducted outside GO ELECTRIC (for example leaflets advertising an online store);

c) setting up accounts for Users in online stores.

13.5.

Goelectric.pl reserves the right to filter and stop messages sent by Users as part of the tools provided in GO ELECTRIC , in particular if they are spam, contain content that violates these Regulations or otherwise threatens the safety of Users.

13.6.

Completed Offers may be published in the subdomain archiwum.Goelectric.pl. The published information is for illustrative purposes only, and Goelectric.pl does not provide and does not guarantee full and comprehensive disclosure of information about completed Offers.


Article 14. CHANGES TO THE REGULATIONS

14.1.

Goelectric.pl is entitled to change the Regulations and this change becomes effective on the date indicated by Goelectric.pl. The date of the change cannot be shorter than 7 days from the moment of making the amended Regulations GO ELECTRIC

14.2.

The user will be notified of such changes and the possibility of their acceptance by e-mail or during the first login to GO ELECTRIC , from the moment the changes enter into force. The acceptance of changes is also considered to be the automatic renewal of the Offer ordered by the User, even without logging in to GO ELECTRIC . If the changes are not accepted, the User, in order to terminate the contract, should immediately notify Goelectric.pl about it, using the methods referred to in art. 15.2. Provisions of Art. 15 shall apply accordingly.


Article 15. TERMINATION OF THE CONTRACT WITH GOELECTRIC.PL

15.1.

The provision of services under GO ELECTRIC is indefinite, subject to the provisions contained below in this article.

15.2.

The User may terminate the contract concluded with Goelectric.pl regarding the Account indicated by him at any time by filling in the appropriate form on the website https://goelectric.pl/en/contact-us or by e-mail to the following address: pomoc@goelectric.pl.

15.3.

The termination by the User of the contract with Goelectric.pl regarding the Account indicated by him shall take effect no sooner than 30 days from the end of his Offer, participation in the Auction or using the Buy Now option and on the condition that all payments for services are paid to Goelectric.pl provided to the User by Goelectric.pl.

15.4.

In the event of a persistent breach of the Regulations by the User, the contract may be terminated by Goelectric.pl with a seven-day notice period.

15.5.

If the contract has been terminated on the basis of a decision by Goelectric.pl, the User is not entitled to re-register the Account under GO ELECTRIC without the prior consent of Goelectric.pl.


Article 16. CONTACT AND COMPLAINT PROCEDURE

16.1.

The User may contact Goelectric.pl regarding services provided electronically on the basis of these Regulations:

a. traditionally in writing to the following address: GO ELECTRIC , ul. Tartaczna 5, 26-600 Radom,

b. electronically (e.g. by selecting the subject of correspondence as part of the contact form available at goelectric.pl/kontakt).

16.2.

GO ELECTRIC may contact the User in the form of:

a. in writing to the correspondence address provided by the User,

b. electronically to the e-mail address provided by the User,

c. by telephone to the telephone number provided by the User.

16.3.

If, in the User's opinion, the services provided on the basis of the Regulations are not provided by Goelectric.pl or are performed contrary to the provisions of the Regulations, he may submit reservations in the manner specified below (Complaint). At the same time, in the case of own sale of Goods by Goelectric.pl, the User may submit a Complaint in the manner described in the content of the Goelectric.pl Offer.

16.4.

Complaints may be submitted electronically using the contact form or in writing. The complaint should contain at least the name under which the User appears in GO ELECTRIC (login), a description of the objections raised and an indication of the proposed method of resolving the Complaint.

16.5.

Goelectric.pl examines the Complaint within 14 days from the date of its receipt. In the event that the Complaint does not contain the information necessary to consider it, Goelectric.pl will ask the person submitting the Complaint to supplement it to the extent necessary, and the 14-day period then runs from the date of delivery of the completed Complaint.

16.6.

The response to the Complaint is sent only to the e-mail address assigned to the User's Account. In particularly justified cases, Goelectric.pl may send a reply to another e-mail address indicated by the person submitting the Complaint, which is not assigned to the User Account, or in writing to the address indicated in the Complaint.

16.7.

The User has the right to appeal against the decision made by GOELECTRIC.pl as part of the Complaint (Appeal). Provisions of Art. 16.3, 16.4 and 16.5 shall apply accordingly.


Section 17. APPLICABLE LAW AND DISPUTES

The law applicable to the contract between the User and Goelectric.pl, the subject of which are services provided by Goelectric.pl as part of GO ELECTRIC under the conditions specified in the Regulations, is Polish law. All disputes related to the services provided by Goelectric.pl as part of GO ELECTRIC will be settled by the competent Polish common courts. The User who is a consumer has the option of using the out-of-court method of dealing with Complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Radom. The user who is a consumer also has the option of using the EU ODR internet platform, available at the following internet address: http://ec.europa.eu/consumers/odr/ . 18.2.

Links placed in the electronic version of the Regulations, including attachments, only facilitate navigating the GO ELECTRIC websites. Documents other than the attachments listed above do not form part of the Regulations.


Section 19. VALIDITY

If any provision of the Regulations is deemed invalid by a final court decision, the remaining provisions shall remain in force.
