RULES OF GO ELECTRIC

As GO ELECTRIC also sells its products on https://goelectric.pl/en/, below we present separate regulations of our company online store, which do not differ in any particular way from the regulations of other online stores:

Regulations of the GOELECTRIC.PL store

These Regulations define the rules for concluding sales contracts via the GOELECTRIC.PL online store, and define the rules for the performance of these contracts, the rights and obligations of the GOELECTRIC.PL store and the customer as well as the rules of complaint procedure.

The GOELECTRIC.PL online store, available at https://goelectric.pl/en/, is run by GO ELECTRIC Marcin Bogdanowicz, with the main business address in Radom at ul. Tartaczna 5, 26-600 Radom (Poland), entered into the Central Register and Information on Economic Activity of the Republic of Poland kept by the Minister of Economy under the NIP number: 7961895421, REGON: 147335650 (hereinafter: GOELECTRIC.PL or the Seller).

THE SUBJECT OF THE STORE'S ACTIVITY

1. The GOELECTRIC.PL store sells mopeds and electric bikes as well as parts and accessories for them through the online store at http://goelectric.pl or otherwise www.goelectric.pl. The website www.https://goelectric.pl/en/ allows you to place orders for the goods specified on the website www.https://goelectric.pl/en/

BUYER

2. The buyer may be a natural person, a legal person or an organizational unit without legal personality, which the law grants legal capacity (hereinafter: the Buyer or the Customer).

PRODUCTS

3. All goods offered in the GOELECTRIC.PL store are brand new, free from physical and legal defects. All goods have been legally placed on the Polish market. In exceptional cases, when it is clearly marked in the name and description of the product, used or serviced goods may be offered.

PRICES

4. All prices given on the GOELECTRIC.PL websites are given in Polish zlotys (PLN), they are gross prices (ie they include all components such as customs and taxes, including VAT). The binding price for the parties is the price at which the customer ordered the goods in the order. The given prices of goods do not include the cost of delivery, which depends on the method of its implementation. After choosing the payment method "bank transfer" with an order value above PLN 500, the customer receives a discount for the next purchases in the store. The size of the discount is proportional to the value of the order, after which the customer received the discount.

TAX PURCHASE DOCUMENTATION

5.1. Fiscal receipts or VAT invoices are issued for all ordered goods in the GOELECTRIC.PL online store. Pursuant to the provisions of the Act of March 11, 2004. on tax on goods and services (uniform text: Journal of Laws of 2011, No. 177, item 1054) and the Regulation of the Minister of Finance of December 3, 2013 on invoicing (Journal of Laws of 2013, item 1485) ), the customer's signature - as the buyer of the goods - is not a mandatory element of the content of the VAT invoice. In this case, the buyer only receives the original invoice. It should be borne in mind that if the buyer who is a natural person places an order or makes a purchase using data (e.g. with the name / company) regarding the business activity of that buyer, it will be presumed that the purchase is made by him in connection with such activity and the invoice will be issued to that buyer as an entrepreneur.

5.2. Pursuant to the provisions of the Act of March 11, 2004 on tax on goods and services (consolidated text: Journal of Laws 2011 No. 177 item 1054), the Buyer accepts the issuing and sending of invoices in electronic form to the e-mail address provided during registration as a new user in the store. The moment of receipt of the invoice by the Buyer is the moment of opening the electronic correspondence with the attached invoice (verified by electronic confirmation of receipt).

ORDERS

6. An order in the GOELECTRIC.PL online store can be placed as follows:

a) using the IT system (website) of the online store by adding the product (s) to the basket and then proceeding to the order processing,

b) by e-mail sent to the following address:

Such an order must contain the name and surname of the ordering party, its postal address and e-mail address, tax identification number (applies only to business entities purchasing the goods and is used to issue a correct VAT invoice), delivery address, telephone number and the name, quantity and price of the ordered goods

c) by phone at the number of the sales department: (0048) 48 685 50 86.

The seller accepts the order for execution after checking the availability of the ordered product in the warehouse.

Orders are processed in the order in which the order was placed. The time of implementation is determined by, among others order number, therefore we encourage you to place orders via the online store system, which guarantees immediate order number.

7. Confirmation of acceptance of the order for execution takes place within 3 working days (working days are understood as days from Monday to Friday, excluding public holidays) from the time the order is placed by the Buyer. Such confirmation takes place after the payment has been settled, which may take longer in the case of installment purchases. After this time, an e-mail will be sent to the Buyer with information about the date of shipment of the goods.

8. In special cases, the seller reserves the right not to accept the order for execution.

THE MOMENT OF CONCLUDING THE SALES CONTRACT

9. If the Seller confirms the acceptance of the Customer's order for execution in the ordering process, in accordance with the regulations set out in points 6 and 7 of the Regulations, a distance sales contract is concluded between GOELECTRIC.PL and the Customer.

TECHNICAL CONDITIONS. PROVIDING ILLEGAL CONTENT

10. In accordance with the obligation resulting from the provisions of the Act of 18 July 2002. on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended), we would like to inform you that in order to be able to use the purchases in our store, the Customer's computer and the software of this computer should meet the following requirements: operational, enabling the launch of the web browser at the recommended screen resolution: 1024 x 768 pixels or higher. In addition, in accordance with these provisions, we would like to inform you that placing any illegal information or information that violates good manners on the website of our store by the Customer is prohibited. The buyer may agree to enable cookies. The User's (Customer / Buyer's) web browser may store text files (cookies) on the computer's hard drive. Cookies contain information necessary for the proper functioning of websites, in particular those requiring authorization.

TIME OF ORDER COMPLETION

11. The order fulfillment time is determined by the merchant at the time of accepting the order for execution. As a standard, it does not exceed 3 business days (for orders placed by 4:00 p.m. on a given day.) If it is not possible to complete the order within the specified time limit, the Seller will inform the Customer about this fact proposing a new delivery date. It is up to the customer to choose, among others acceptance of a new date or withdrawal from the contract.

METHOD OF FULFILLING THE ORDER (DELIVERY OF GOODS)

12. The ordered goods are delivered in the manner indicated by the Customer at the time of placing the order:

a) Shipment sent via courier (as a rule, it reaches the customer on the second working day after the date of sending the package. All shipments sent via courier are insured - the insurance costs are borne by the seller.)

b) Receiving the order in a parcel locker.

c) Shipment sent via the Polish Post.

NOTE: If the Seller sends the goods and the Customer does not pick them up, the Seller will request a refund of the return shipping costs. Therefore, the customer should make sure that both the collection date and contact details are correct.

PAYMENT

13. Payment for the goods can be made in the manner selected at the time of ordering. Payment by bank transfer is preferred over fast electronic payments such as PayU, Przelewy24 or PayPal. After choosing the payment method "bank transfer" with the value of the order above PLN 500, the Customer may receive a discount for the next purchases in the store. The size of the discount is proportional to the value of the order, after which the customer received the discount. We reserve the right to request an advance payment for the purchase of goods imported to order and of significant value. However, in the event of termination, withdrawal or termination of the contract, the advance payment will be returned to the Consumer. WITHDRAWAL FROM THE CONTRACT BY THE CUSTOMER

14. A customer purchasing as a consumer (i.e. as a natural person who purchases goods for purposes not related to business or professional activity) who has concluded a distance contract via the GOELECTRIC.PL store, regardless of the form of delivery or receipt of the goods, may withdraw the contract without giving any reasons by submitting a relevant declaration in writing within 14 days from the date of delivery of the goods constituting the subject of this contract. To meet this deadline, it is enough to send to the Seller, before this deadline, an appropriate statement by e-mail, the store's contact form or by post to the address Tartaczna 5, 26-600 Radom, Poland. 15. In the event of effective withdrawal from the contract, the contract is considered void and the consumer is released from any obligations. The return of the goods should take place immediately, along with the sending of the statement referred to in point 14, or separately - but not later than within 14 days from the date of sending the statement on withdrawal from the contract. The returned goods must be in an unchanged state, unless the change was necessary within the limits of ordinary management. The consumer should return the goods in such quantitative and qualitative composition, subject to the previous sentence he received. In particular, he should attach all parts, accessories, instructions, conditions of use etc. documents received with the goods. Returned goods should be safely packed and sent at your own expense to GOELECTRIC.PL to the following address: ul. Tartaczna 5, 26-612 Radom, Poland.

16. The reimbursement of the price of the goods paid by the Customer along with the shipping costs from the Seller to the Customer will be made immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract. Shipping costs from the Seller to the Customer are reimbursed only up to the amount corresponding to the cheapest shipping option available in a given offer (except for personal collection PLN 0). Return shipping costs from the Customer to the Seller are not reimbursed.

LIABILITY FOR DEFECTS OF THE GOODS AND FOR ITS COMPLIANCE WITH THE CONTRACT AND COMPLAINT PROCEDURES

17. Goods offered in the GOELECTRIC.PL online store are covered by the manufacturer's, distributor's or GOELECTRIC.PL's warranty. If the original warranty card is delivered with the goods, warranty repairs are carried out by authorized service points throughout the country. The warranty period and conditions are marked in the warranty card and next to the description of a given product. GOELECTRIC.PL provides a 12-month warranty for the mopeds and bicycles sold. The warranty does not cover transport costs when partner repair facilities are available in the customer's city of residence.

18. Before collecting the purchased or repaired shipment from the post office or from the courier, check that the packaging has not been damaged during transport. In particular, pay attention to the condition of the tapes attached to the package. If the packaging of the parcel is damaged or the tapes are broken, do not accept the parcel and open it in the presence of the courier, possibly draw up a damage report and contact the seller as soon as possible to clarify the matter.

19. Complaints regarding repairs may be submitted via the online form here or, in special cases, sent to the following address: GOELECTRIC.PL, ul. Tartaczna 5, 26-600 Radom, PL (or via the on-line form by attaching a complaint letter as an attachment). The text of the complaint should contain a detailed description of the defect and the date of its occurrence as well as expectations regarding the manner of complaint processing.

20. Complaints regarding returns may be submitted via the online form here or, in special cases, sent to the following address: GOELECTRIC.PL ul. Tartaczna 5, 26-600 Radom, PL (or via the on-line form by attaching a complaint letter as an attachment). The text of the complaint should contain a detailed description of the defect and the date of its occurrence as well as expectations regarding the manner of complaint processing.

21. Within 14 days from the date of receipt of the complaint, the Seller should settle the complaint and provide the Buyer with a specific answer regarding the acceptance or rejection of his complaint. If the Seller accepts the complaint, the Buyer will be indicated the manner and procedure proposed by the Seller for its implementation. In the event of refusal to accept the complaint, the Buyer will be presented with the justification for this refusal.

22. Complaints will not be accepted when:

a) the goods have been mechanically damaged for reasons for which the Seller is not responsible, in particular as a result of improper use.

b) The customer does not have the original purchase document (invoice or fiscal receipt) and it cannot be otherwise verified whether the product was purchased by that person.

23. The guarantee for the sold consumer goods does not exclude, limit or suspend the rights of the buyer resulting from the non-compliance of the goods with the contract.

24. If the buyer is not a Consumer, the parties exclude the seller's liability under the warranty for physical defects of the goods (Article 558 § 1 of the Civil Code)

PERSONAL DATA PROTECTION

25. Providing personal data by the Customer is voluntary, however, failure to provide such data will make it impossible for the Customer to make purchases. By making a purchase or registration, the Customer may consent to the collection, processing and use of the Customer's personal data by the seller for the purpose and to the extent necessary for the seller to perform the order (i.e. to deliver the shipment to the customer and make settlements). The Customer's personal data may be transferred to third parties only for the purpose and to the extent necessary for the correct implementation of orders or complaints, in particular to intermediaries in ordering courier services, postal operators and courier companies for the purpose of sending the parcel or to repair facilities for the purpose of repairing.

26. The data will be processed in compliance with all security requirements specified in Regulation (EU) 2016/679 of the European Parliament and of the Council and the Act of August 29, 1997. on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended) and in the implementing regulations issued on their basis. The customer has the right to freely access (inspect) their personal data, the right to correct them, as well as the right to request the cessation of their processing and their removal from the database, which should be reported to the data administrator, in writing by traditional mail or e-mail at: sklep @ https://goelectric.pl/en/ or info@goelectric.pl. The administrator of clients' personal data is GO ELECTRIC Marcin Bogdanowicz, based in Radom at ul. Tartaczna 5, correspondence address: ul. Tartaczna 5, 26-600 Radom, Poland.

The customer is responsible for providing false personal data.

APPLICABLE LAW

27. The information on the websites is only an invitation to conclude a contract within the meaning of the Civil Code.

28. In matters not covered by these regulations, the provisions of applicable law, including the provisions of the Civil Code, shall apply.
